Thc request is to permit boaL, not extending more than twelve (12) feet into the creek and/or more than one-third (1/3) across the width of the creek. In the event you deeide to approve the Violas' request, we ask that the language be clarified to indicate a specific width of vessel which may be moored at the dock. If the approval refers to a fraction of the creek without specifying the wid1h of1he creek, it may be difficult, in the future, tn detemline how wide a vessel could be. Several suggestions for language would he: 1) "The vessel may no! extend into the creek more than twelve (12) feet into tJle creek or one-third (1/3) of the width uflhe creek." This would indicate that tbe vessel cannot be any more than the speciJied lootage. unless the creek is more tJlan three times that width; 2) 'The vessel may not exlend more than the greater of (i) twelve (12) feet or (ii) one-third of the width ofthe channeL" I believe this accomplishes the same purpose, 3) Anolher possibility, if feasible for this creek, would be tn specify attbis lime tJle width or the creek.
