The letter states that the property does not display all of the biological characteristics required to meet the definition of a NY State regulated freshwater wetland. The letter also states that plant assemblages which meet the required NYSDEC definition of a freshwater wetland were found on nearby properties to the north of Soundview Avenue not on the northern portion of my land This letter was addressed to Norman Wamback the former owner. I had purchased the property from Mr. Wamback and taken title to the property in August 2001. The letter should have come to me. I request that this letter become a part of the Trustee File for this property. I realize that the Trustees have their own jurisdictional rules, however, I believe that having accurate information from the NYSDEC is significant. Thank you for your attention. Town of Southold SCTM# 1000-054-07-01.003 Dear Mr. Wamback: On or about September 14, 2000, you were issued a letter by the undersigned indicating that your proposal to construct a new single family dwelling with septic system and driveway on the referenced parcel is located more than 100 feet from regulated freshwater wetlands,and therefore outside the area regulated by the Department of Environmental Conservation under the Freshwater Wetlands Act and its implementing regulations, the Freshwater Wetlands Permit Requirements Regulations. It has since come to my attention that the September 14, 2000 letter does not adequately explain the regulatory situation or project circumstances on your property. Staff from our Bureau of Habitat inspected the property in August 2000, at which time an area of wet soils and several species of freshwater wetland plants were observed on the northern portion of the lot.It was noted that the landward edge of this area had been delineated by this Department in 1997.However,further inspection revealed that this wet area on the northern portion of your property does not display all of the biological characteristics required to meet the definition of a regulated freshwater wetland. Specifically, we found that the majority of the plant species growing in this area are not listed in the regulations as wetland indicators. Since at least 51% of the plant species growing in an area must be listed in the regulations as wetland indicators for that area to qualify for consideration as a state regulated freshwater wetland,the northern portion of your property does not meet the regulatory definition of a freshwater wetland.Plant assemblages which meet the required definition were found on nearby properties to the north of Sound View Avenue, greater than 100 linear feet from the construction/disturbance area on your property. Based on the information you submitted with the original jurisdictional inquiry and our subsequent inspection of the subject property and nearby parcels, we have confirmed that your proposal to construct a single family dwelling, septic system, driveway and well on the referenced property as shown on the April 20, 2000 survey by Stanley Isaksen,signed June 30, 2000 is located more than 100 feet from regulated freshwater wetlands. Therefore, no permit is required under the Freshwater Wetlands Act to undertake the activities described herein and shown on the referenced survey. However, please be advised that all construction, clearing and/or ground disturbance must remain more than 100 y feet from the freshwater wetland boundary. The proposed action is _ vàgue and unspecified, As you are aware, a small freshwater wetland exists on the north of the property. The wetland was flagged and verified by the DEC on 12/97 and again on April 12, 2000 by En-Consultants, Past correspondence in the file references a culvert (since removed) from Sound View A venue to the depression. The property owners stated that the runotT from Sound View A \'enue through lhe culvert was the cause of the wetland. This statement is partially correct, the wetland is within the watershed for Lily Pond and continues to receive runoff from Sound View Avenue and the surrounding slopes. An existing cut from Sound View A venue contributes standing water to the system, together with, the on-site swale ranging from 20 N,G.V,D, to 8 N,G.V.D. The construction of Sound View Avenue, interrupted the natural drainage of the watershed and contributed to longer hydro-periods. Regardless, the area is still a wetland. As stated above, the "selective" clearing and grading request is vague and should be mapped on the existing survey. The action would occur within the 75 buffer and the extent of the proposed action cannot be assessed. [recommend that the trees that are to be removed be mapped upon the survey and labeled in the field to avoid illegal clearing in the future, In addition, a simple grading plan should also be submitted to your office. In the event that a large area of grading or tree removal should occur, [ recommend that hay bales be installed to prevent adverse impacts to the wetland. Recognizing that this lot is sensitive, please note that upon the approved survey Note 2 states that "No disturbance on North side" will occur; in addition a 10 foot limit of . . clearing was proposed on the west, south and east sides. These statements were evaluated previously by the Board during the permit process for the residence and should be weighted in any upcoming decisions, This action would be within 100 feet and would also require a permit from the DEC as stated in their Letter of Non-jurisdiction. I have come before the Board essentially for guidance and clarity with regard to the parameters of my building envelope. I also hope to find resolve and closure in this matter. I have followed the parameters of the original permit that was handed down to me by the previous owner (Norman Womback) to the best of my ability. I designed a home that would fit into the building envelope with room to spare (5') to the south. Unfortunately, during the surveying and staking process, my entire foundation was moved 5 feet to the south. Pushing the house/foundation 5 feet further away from the wetlands barrier. When we began the original excavation it was our goal to leave as many large trees intact around the building envelope as possible. This is still our goal. Unfortunately, though, we have a situation in which we must fortify the land to the north of the foundation either by creating a more gradual plane of earth between our foundation and the clearing parameters or the construction of a retaining wall requiring a footing. . . After speaking with the Trustees at the field investigation on 9/17/03, I believe we will be able to complete the necessary grading or building of a retaining wall, while basically staying within reasonably close proximity to the original building envelope approved by the Board, as we are allowed to use the clearing parameters originally approved. It is my understanding that it may be necessary to take down a few large trees that fall within these parameters in order to complete this necessary work. New York 11971 Re: Selective Cutting at 2710 Horton Lane Southold New York 11971 Applicant # 1000-54-7- \.3 To whom it may concern, Intention of applicant # 1000-54-7-1.3 to selectively cut trees and grade to the North side of house is not specific enough for us. Owners purchased a, environmentally protected, parcel and placed footprint of house on boarder adjacent property within the town code but nearest property line. The sketch given to us for perusal gives us the impression that it could be clear cut and graded to an excess and thus effecting the environments wet lands. We would not object to clearing dead trees and under bush. We do not want any living trees moved from site or any grading done to the natural nature of the landscape. It is not our intention to be nasty neighbors and trust an understanding can be made in that the property when purchased was and still is a wet land parcel. We would like to preserve our environment for future generations. SCTM# 1000-54-7-1,3 I conducted a site visit and determined that tile area is a freshwaler wetland dominated by red maple and black ash trees. Standing water was present. The wetland hydroperiod is dependent upon precipilation and hence runoff form the adjacent slopes and Soundview Avenue..,it is the lowest point in a large swale, The trees exhibited stained trunks indicative of long periods of standing water. Box 1179 Southold, NY 11971 Dear Mr. Krupski, On Friday a Variance application was submitted to you along with a check for $150.00 pertaining to the building permit for my lot on the comer of Soundview A venue and Hortons Lane, You will recall conversations Gary Olsen had with you recently, regarding the fresh water wet lands issue that Southold Town insists exist on my property, When I purchased this property in 1983, I received a Vacant Land Certificate of Occupancy from Southold Town with no mention of fresh water wet lands. [n 1987 I noticed after rains storms, substantial rainwater was co\1ecting in part of my lot for a day, then draining into the ground. Much to my amazement I found that Southold Town installed a culvert into my property which diverted rainwater off Soundview A venue from its long incline to the west and east of my property. At that time 1 wrote several letters to Raymond Jacobs at the Southold Highway Department requesting the removal of the culvert. These went unanswered until I confronted Mr. Jacobs at the Highway Department. Wanting to be cooperative with Southold Tovm, foolishly being 'Mr. Good Guy', I allowed Mr. Jacobs to keep the culvert there temporarily, He gave me a letter on June I, 1987 stating it would be removed upon my request. No water ever stood for long periods of time, nor did wet lands vegetation ever grow in the area since 1987. Standing water and wet lands vegetation is criteria for wetland designation, both of which the area on my lot lacks, and always has, For about the last two years I have been writing to the Southold Town Highway Department requesting the removal ofthe culvert, and again, no reply, The culvert was only removed after I was forced to hire an Attorney in Riverhead concerning the matter. Another expense put on me by Southold Town. It was clear to my Surveyor that the so-called 'wetland' spot on my property was caused by the water from the culvert. You could see a clear path from the culvert to the low spot I .I~ . . collecting the rainwater. I also have photographs of the entire area before the culvert was removed which show this path made by the rainwater. Once the culvert was removed, the DEC returned a couple of months later as I was applying for a building permit, and found the area dry. They took the area off of their designated wet lands list, and removed the orange flags they had initially placed to the area two years ago. It puzzles me as to why Southold Town insists this is wet land area when it is obvious it is not. I have been working on obtaining permits regarding a building permit for 10 month now which all fall back to the wet land issue. So far these permits have cost me $4,528. 00 and I am not finished with it yet. Friday I was told by the Board of Health the designed area for the cesspool is between two enormous oak trees. Because of the Town wetlands designation, this is the only area the Board of Health will allow the cesspool. To dig the test hole, the two oak trees will have to be removed at an approximate cost to me of$I,OOO.OO. My Father was a bayman, operating a party fishing boat out of New Suffolk and Greenport from 1936 until he retired in 1970. From a child on I remember vividly how he would teach me environmental conservation regarding Peconic Bay, as well as instructing his fishing parties that would hire his boat for the day. In addition, he would not allow any item, bottles, cans, and garbage thrown overboard. He was a conservationist before the word was popular. He was a friend of South old Town. I have always followed in his teachings. A few years ago [volunteered to assist with the Town Coastal Erosion Project. If you recall, I gave a presentation before the Town Board, along with a time consuming 5-booklet study I put together single handedly. At the time the Board of Trustees was so impressed with it that they requested a copy. Valerie Scropaz also requested a copy for the Town Archives. I took the time to put another 5 booklets together for her. This paragraph is to demonstrate to you that my family and I have always supported the Town of Southold with their issues, and continue to do so. At this point, however, I feel as if I am being dumped on by Southold Town, and I don't deserve this. I am requesting the Board of Trustees take another look at the area in question where you will find no standing water and no fresh water wetlands vegetation. I will be pleased to walk the area with the Town Board of Trustees at their convenience. On site I will show the photographs of the rainwater path that used to exist from the culvert that caused the misconception of wetlands, and also answer honestly any questions the Town Trustees may have.
