24th, 2003 took the following action.
RESOLVED, that the Southold Town Board of Trustees Approve an Amendment to Pennit
#5238 for ROBERT & BARBARA HOLLEY to remove the existing driveway and modify
the design ofthe previously approved for gravel driveway attendant to the detached garage.

At the meeting of the Southold Town ConserVation Advisory Council held Tuesday,
September 23, 2003, the following recommendation was made:
Moved by Drew Dillingham, seconded by Donald Wilder, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Amendment application of ROBERT E. & BARBARA C. HOLLEY to Amend Permit
#4238 to remove the existing driveway and modify the design of the previously
approved-for gravel driveway attendant to the detached garage.
Located: 1085 Bayshore Rd., Greenport. SCTM#53-3-12
The CAC recommends Disapproval of the application because of the following reasons:
1. The driveway is "as-built".
2. There is no non-turf buffer as required in Permit #4238.
3. Applicant has violated no-disturbance zone.

Dear Mr. Krupski,
As you know, this Firm represents Mr. and Mrs. Holley, owners of the above referenced
property, who benefit rrom a Town of South old Wetlands Permit to construct a detached
garage thereon. Subsequent to the completion of said construction, the design of the
gravel driveway was modified. Accordingly, approval to modify the in-force permit is
now required in order to reflect this change. Please find enclosed herewith:
(I) Town of Southold Board of Town Trustees Letter of Request for
an Amendment;
(2) Certified Mailing Receipts to the adjacent property owners
concerning the proposed modification;
(3) Survey of the above referenced property, prepared by Joseph
A. lngegno, L.S., last dated July 8, 2003, indicating the
modification to the proposed gravel driveway (two [2] copies);
and
(4) Check made out to the Town of South old in the amount of
$ 40.00 to cover the requisite application fee.

The CAC recommends Disapproval of the application because of the following reasons:
1. The wetlands should be flagged.
2. CAC questions the 30' buffer, which cannot be achieved. The
buffer should be flagged.
3. The CAC recommends that the garage be moved closer to the
existing property, further away from the wetlands.

This Firm represents Mr. and Mrs. Holley, who had recently applied for approval for the
transfer of the above referenced Permit (No. 5238) trom your Board on March 28,2002.
In the interim, we would also request for the amendment of subject permit in order to
reflect Mr. and Mrs. Holley's proposed improvements thereon. Please note that Mr. and
Mrs. Holley have purchased and subsequently merged subject property with their own
property to the immediate east. Enclosed herewith please find:
