This special e~ception for the removal of the
d elapidated gas station to a ooint well in back of
its oresent location and the re01acement ( a new
modern set uo ) was, among other considerations,
the orobable develooement of this area as well as
the ~mprove~.ent of aooearance of the area. The
need of the neighborhood for better service station
facilities and. the arrangement of the new station
so that uusi~htly vehicles etc. would be keot unSer
cover. There were many minor considerations as
welt an5 inasmuch as the owner was willing, as one
of the conditions, to purchase land adjoining, the
whole set uo was definitely to the advantage of
the nei2hborhood.
The present gasoline pump island is now practically on the
highway and cars are parked, at times, on the road. This will
be elLminated.

A regul~~ meeting of the Southold Town Board of Appeals was
held at 7:30 P.M. on Thursday, June 26,1958, in the Town Clerk's
Office, Southold, Ne',' :lork.
There \Je:'e present: Messrs. Rotert i'l. Gillispie, Jr.; Chi.~r-
Rotert Bergen, Herbert Rosenberg and Charles Grigonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also present: Mr. Howa~d M. Terry,Building Inspector.
Putlic HSARING: Appeal No. 68 on application of Baker & Fick-
eissen, Boisseau Avenu~, Southo~d, New York, en behalf of Harold
Holmberg, North Road, Greenport,N.Y., for a variance to the Zoning
Ordinance under Article III, Section 307,. ,
The Chairman opened the hearIimg by reading the appea'I. letter
to applicant advising of date of public hearing and legal notice
with affidavit attesting to publication.

ChairTan: Is there anyone present who wishes to speak for
thi.s appeal ?
Mr. HOlmberg: I just wish tosay that the garage was built
long before the enactment of the Zoning Ordinance and I have now
retired and we are mak&ng this our home now and the garage is not
large enough to store my car and boat during the winter months.
Location of prope~ty: North side of North Road, Route 27A,
Greenport, N.Y.
The Chairman then asked if there vas anyone who wished to
speak against the appeal and as there was no response the Board
reviewed the application and unanimously granted the variance.
It was the Board's deter mination that the strict application
of the Ordinance would produce undue and unique hardship as the house
and garage "ere built before the enactrJent of the Ordinance and the
additional 6 foot garage space viaS needed in this particuIDr in-
stance and most all neighboring properties had sufficient gar~ge
space, and this additiomL 6 feet added to the existing garage
would not affect the character of the district.
Minutes of the June 12th meeting were read. On motion duly made
byMr. Rosenberg, seconded by Hr. Bergen, and carried,Minutes were
approved as submitted. .
The Chairman advised the Board members th8t Be had been asked
by Mr. Charles M. King for a written interpretation of the stip-
ulation in the special exception which was gr~nted to him to erect
A gasoline station. The Secretary was dire~ted to write.Mr. King
advising that the Board's interpretation concerning the erection
of a gasolin@ station, with pumps,lubricaiing and other devices,
all fuel oil and similer substances to be located or stored at least

PUBLIC H3ARING: Appeal No. 67 on application of Nick Houlis
Bay Avenue, East Marion,New York, for r, speoial exception to erect
directional signs under Article III, Section 300, Suvsection II of
the Zo~ing Ordinance.
After re~ding the applic~tion letter to applicant advising him
of date of public he<1ring and legal notice of he::lr~.ng with affidc>vit
attesting to pUblication, the Chairman asked if there were anyone
pre~ent who wished to speakeither for Dr against this appeal. There
was no response to the Chairman's question and the Board unanimoU$ly
granted tijB special excepti~n qS follows: Perm~ssion was granted
to erect a 2' x 3' directional sign on north side of North Road
(Route 25 ),at the intersection of Main Street, Greenport,N.Y., for
a period of ~ months. This permission to be renewable providing
permission is granted by the owner of the property, unless revoked
by the Board of Appe::ls. Chairman read letter- from Mr. A.AStraussner
owner of property, granted >Ir. Houlis permission to erect this sign.
In the absence of authorization rrom Charles King granting Mr.
Houlis permission to erect a 3' x 3' sign at the Shell Station,
Notth Road, Greenpoet,N,Y., it was the unAmous decision of the
Board to continue this part of the appeal until such permission is
obtained and the special exception for this signwas not granted at.
this time. .
PUBLIC H8ARING: Appeal No. 69 on application of Harold R. Reeve
& Sons ,Main Road, Mattituck, New York, on behalf of John Gunther,
Mattituck, N,Y., fora variance due to lack of access. Location of
property: Knollwood Terrade,Mattituck, N.Y.
Chairman read the ap~eal, letter to appellant advising of date
of public he<>ring, legal notice ..ith affidavit a ttesting to publi-
cati'm and Notice of Disapproval by the Building Inspector on appli-
cation of Harold R. Reeve & So~s for permit to build.
There was no response to the Chairmans Questioning as to whether
there was anyone present who ~ished to speak either for or against
this appeal. It v)",s the determination of the Board that this appeal
be Granted as the lot is of ample size and the private right of \-Iay
is the only means of access and has been in existence for some time.
Approval of access was un ani~ously gra~ted as follows: A 20 foot
right of way bordering the westerly line of Lot No, 7 to Lot Nc~5 at
Knollwood Terrace, Mattituck, N,Y.
PUBLIC H~ARING: Appeal No.71 on application of Andrew Cook of
Mill Road Mattituck New York, for a special e':ception to the
Zoning Ordinance, urlder Article Ill, Section 300, Subsection II,
for the permission to erect direction adverti~ing signs.
The Chairman opened the hearing by reading application,letter
to ~jr. Cooke,advising of date of hearing and legal notice with affi-
davit atteshng to the publication of notice in the local ne\oJspaper.
Chairman asked Mr. Cooke, who was present at the hearing, to.

May 29, 1958
A regular meeting of the Southold Town Board of Appeals was
held at the Town Clerk's Office, Southo1d, New York, on Thursday
evening, May 29, at 7:30 P.M.
There were present: Mr. R.W. Gillispie, Jr.; Chairman, Mr.
Robert Bergen, Mr. Herbert Rosenberg and Mr. Charles Grigonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also presnet; Mr. Howard M. Terry, Building Inspector.
PUBLIC HEARING: Appeal No. 63 - Application of C~ar1es M.
, King of Sunset Shores, East Marion, New York, for a special exception
under the Zoning Ordinance to demolish present gasoline filling
station and erect a new gas station on the same 10c~tion.
Application was read by the Ch~irman as well as the legal notice
of public hearing and affidavit from the Long Island Trave1er-Mattituc
Watchman attesting to the pUblication of notice, and le.ter to capp-
licant advising date of public hearing.
Chairman: Is there anyone present who wishes to speak for
this application?
Mr. King submitted a blueprint of the proposed gas station
building for the Board's review. Discussion was held regarding
distance from easterly line of property to east side of present
bui~dingbui1ding, a distance of approximately 16 feet. A
possibility of acquiring fifty feet additional frontage on the East
exists. Discussion was also held on the proposed location, setback,
tank size and location, etc.
Chairman: Is there anyone present who wishes to speak against
this application?
No one spoke against the appeal. General conditions relative
to gasoline stations, !tipu1ated in the llIinutes of April 3, 1958,
were read and imposed. Discussion was held regarding relocating
present sign and it was the decision of the Board that the sign
must be moved, if necessary, to conform to five foot sejback
from all property lines, in accordance with the Zoning Ordinance.
The estimated cost of the new building - '13,500.00. It was noted
that a "B" Business district was applied for but that no action
has yet been taken by the Town Board on this Matter.
It was the Board's decision that the easterly side of the new
building should be located at least 20 feet from present easterly
property line of Charles M. King and that north side of proposed
building be located at least 20 feet south of and parallel to
location of present struc~ure.
Appeal was unanimously granted. Board reasoned that the new
station does not constitute an expansion of a non-conforming use
and that it will in fact be smaller than the present station and may
be expected to enchance the character of the neighborhood.
