Property Location: 74500 Main Road, Greenport
CTM No. 46-1-2.3 (formerly CTM 46-1-1, 2.1)
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's property is improved as a building supply
facility on 5.9 acres, located on the south side of the Main Road in Greenport, located in the LIO
(Light Industrial Office) Zone. The neighborhood is commercially developed.
BASIS OF APPLICATION: Building Department's February 3, 2004 Notice of Disapproval, citing
Code Section 100-205.1C in its denial of a building permit application concerning placement of a
wall sign, for the reason that Section 100-205.1C limits two signs in the LIO zone district, and the
applicant's sign is a third sign.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on June 22, 2004, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to place a 80" wide x 20" high,
electrical back lit, hinged cabinet sign on the front wall to design the Andersen window and door
showroom, with capital letters 9" high. The sign is in addition to two other commercial identification
signs displayed by the owner, Riverhead Building Supply Company.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The property is located in a commercially
developed area. The sign will not be 20" or less in height, and provides for advertising and viewing
for the business, before, during and after business hours. The sign will be placed at the opposite

end of the owner's identified sign, and is for the purpose of identifying the showroom area within the
building used by one of the main suppliers.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than a variance.
3. The variance granted herein is substantial.
4. The difficulty was self-created when placement of the supplier's sign was proposed in
nonconformity to the current Town Code requirements.
5. No evidence has been submitted to suggest that a variance in this commercially developed area
will have an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of a wall sign identifying supply material for the showroom, while preserving and
protecting the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Vice Chairman Orlando, seconded by
Member Goehringer, and duly carried, to
GRANT the variance as applied for, as shown on the color photographic image and building
layout submitted by Peconic Sign Co.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly
addressed in this action.

This request for a zoning variance is for the purpose of installing of an additional sign
on the Riverhead Building Supply building on Route 25 in Greenport.
The additional sign would identify the Andersen Window and Door Showroom.The
area of the building designated is set aside for the specific purpose of the showroom.
The size of the building allows for the sign to fit proportionately and be unobtrusive.

BASIS OF APPEAL: Building Inspector's.Notice of Disapproval dated February 20, 2002,
denying A permit to(a)construct and locate a new building(No.1)with more than 60 linear feet
of frontage on one street, (b) construct and locate a new building (No.2)with more than 60
linear feet of frontage an one Street,ref.Section 100-133C,and (c)to construct and locate off
Street parking at Tess than the required 50 foot minimum to the street and lot lines pursuant to
section 100-131C(9).
AREA••VARIANCE REQUESTED:. Applicant is requesting the board to reverse the building
ins`pector`s.determination that,a variance is required for the proposed 115-foot width of building
No:1 because under-prior Appeal No.4547,dated June 23,1998,the board granted a variance
to•cor troct,a`115-foot wide building in almost the identical location.Applicant is requesting the
board-to reverse the building,inspector's determination that a variance is required for the
prgposed 9I;foot width-of building No. 2 because the building does not have frontage on a
Street:and isjocated behind building No.1 more than 300 feet from the Main Road.Applicant is

FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 16,2002 at which
time written and oral evidence were presented. Based upon all testimony, -documentation,
personal inspection of the property, and other evidence, the Zoning Board finds the following
facts to be true and relevant:
1.(PROPERTY FACTS) The subject property consists of a total of 5.9 acres and is located on
the south side of Main Road in Greenport. The property is zoned LIO (Light Industrial Office)
and is located'in a neighborhood that is commercially developed. The site plan, prepared by
Donald Alan Denis,Architect,dated August 21,2001,last amended December 18,2001,shows
plans to demolish the existing building and construct a 14,100 sq.ft.retail/office warehouse with
a width of 115 feet facing the Main Road.This building, No. 1 would be set back 110 feet from
the Main Road,with customer parking in front of the building and a 25-foot buffer zone between
the parking areaand'the Main Road. Building No.2 is proposed for the drive-through operation
of the lumbei yard.It is 23,660 sq.ft.with a proposed width of 91 feet Building No.2 is located
70'feet behind building No 1 and more than 300 feet from the Main Road.The site plan also
shOws a.500 sq.ft.warehouse building.

2. In reviewing the revised plan,the board finds that it is not substantially different than the plan
which was reviewed by the board and granted variances under Appeal No.4547.Instead,of one
large building pf 53,425 sq. ft., the applicant has reduced the size of the principal building to
14,100 sq.ft.,end created a separate 23,660 sq.ft.building in the rear of the-principal building
for the drive:through'operation of the business,and a 5,000 sq.ft warehouse building.
3.The 115-foot proposed width of building No.1 is identical to the width variance granted by.the
board urtdi r Appeal No.-4547.The board-notes`that the.prior variance was grantedon-cohdition
that the:applicant-maintain a:tpinimum`110 foot set back from Main Road in order to.provide
additional landscape buffer which tine applicants have cotripliedwith,Since neither the 115foot
Width,of the building nor theminimum 110 foot conditioned set back to the•Main<'Raad have
changed,no futthervariance is required for building No:1. .
4. With respect to=,building,No 2,the,building,inspectorstates that the proposed construction is
not pannitted'pursuent_ta,Arti le•Xlll, Section 100-133C on the grounds that the building has
"linear frontage of'91feet:" .The code provision specifically states that, "a project shall be
divided-into'separate:struetures'so that no sinale.stnicture shall more than sixty(60)linear feet
of'frontacte.on one f1)street"'The I uilding?(No.2)in question does not have frontage on one

RESOLVED,to REVERSE the Building Inspector's February 20,2002 determination that
Building No. 1 requires a vanance pursuant to Article XIII, Section 100-1330 because
such variance was granted under Prior Appeal No 4527,dated June 23, 1998.
BE IT FURTHER,RESOLVED to REVERSE the Building Inspector's February 20,2002
determination that;Building No-2 requires a variance pursuant to Article XIII, Section
100433C because such building;does'not have frontage on a street and the provision is
not applicable to this•structure.

Re: Chapter 58 — Public Notice for Tuesday, June 22, 2004 Hearing
Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Long Island Traveler-Watchman newspaper.
1) Before JUNE 8:
Please send the enclosed Legal Notice, with both a Cover Letter including a contact person
and telephone number, and a copy of your Survey or Site Plan filed with this application which
shows the new construction area, CERTIFIED MAIL, RETURN RECEIPT REQUESTED, to all
owners of property (tax map with property numbers enclosed), vacant or improved, which abuts
and any property which is across from any public or private street.
Use the current addresses shown on the assessment rolls maintained by the Town Assessors'
Office located at Southold Town Hall (631 765-1937) and the County Real Property Office at the
County Center, Riverhead. If you know of another address for a neighbor, you may want to
send the notice to that address as well. If any letter is returned to you undeliverable, you are
requested to make other attempts to obtain a mailing address or to deliver the letter to the
current owner, to the best of your ability and to confirm this in either a written statement, or at
the hearing, with the returned letter.
AND by June 8: please either mail or deliver to our office your Affidavit of Mailing (form
enclosed) with parcel numbers, names and addresses noted, and return it with the white
receipts postmarked by the Post Office. When the green signature cards are returned to you by
the Post Office, please mail or deliver them to us before the scheduled hearing. If any
signature card is not returned, please advise the Board at the hearing and return it when
available. These will be kept in the permanent record as proof of all Notices.
2) By JUNE 13:
Please make arrangements to place the enclosed poster on a signboard such as plywood or
similar material, posting it at your property for at least seven (7) days. Securely place the sign
on your property facing the street, no more than 10 feet from the front property line bordering
the street. If you border more than one street or roadway, an extra sign is available for the
additional front yard.
Please also deliver your Affidavit of Posting to our office on or before the day of the hearing.
If you are not able to meet the deadlines stated in this letter, please contact us promptly.
