PROPERTY FACTS/DESCRIPTION: The applicant's 12,198 sq. ft. lot has frontage along two roads, Illinois Avenue to the west and Meday Avenue to the north. The lot is improved with a single-story, one -family dwelling located in a nonconforming location with 23.4% lot coverage. BASIS OF APPLICATION: Building Department's December 3, 2003 Notice of Disapproval, amended September 21, 2004, citing Sections 100-242A and 100-244B, in its denial of a building permit to construct additions and alterations. The reasons stated in the Disapproval are that the new construction is not permitted because such additions will increase the degree of nonconformance, with a rear yard setback of 19.6 feet, single side yard of 5.6 feet, and lot coverage at 29.6%. The existing setbacks of the one-story dwelling as exist are 17.5 feet from the rear yard line, 5.6 feet on a single side. The existing lot coverage is noted as 23.4%. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 18, 2004 and December 16, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant originally requested the following variance relief to construct additions and alterations to the existing single-family dwelling as shown on the November 12, 2003 survey, revised ,September 10, 2004 for: (a) a proposed increase in lot coverage from 23.4% to 29.6%; (b) a proposed garage addition 12.5+- feet from the easterly (side) line at its closest point; (c) conversion to living space of the existing garage which is 5.6 feet from the easterly (side) line at its closest point, after__attaching it as part of the principal dwelling; (d) proposed second-story addition starting at 26+- feet from the rear property line, beyond the existing 17.5 ft. rear yard setback, and 7.9 ft. front yard setback. r i 1 Page 2—December 29,2004 ZB Ref.5621 —Ellen Schulteis CTM Id: 113-11-4.1 ADDITIONAL INFORMATION:AMENDED RELIEF: During the November 18, 2004 public hearing, the applicant was requested to reduce the proposed lot coverage for a possible alternative plan that would be more conforming to the code's 20% lot coverage limitation. On December 10, 2004, the applicant submitted a revised survey plan for 25% lot coverage, reduced from the original request of 29.6%. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant does not propose to increase the existing setbacks, rather the request is to fill in the existing foot print and to add a second story to a portion of the building. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is small and the house, as exists, already exceeds the minimum requirement of lot coverage and setback from the property line. 3. The variance granted herein is not substantial. 4. The difficulty was not self-created. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Acting Chairman Orlando, and duly carried, to DENY the relief requested to increase the total lot coverage from 23.4% to 29.6%, and to GRANT Alternate Relief of a total lot coverage not to exceed 25%, as applied for, as shown Page 3—December 29,2004 - ZB Ref.5621 —Ellen Schulteis CTM Id: 113-11-4.1 on November 12, 2003 survey, revised September 10, 2004. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The applicants wish to renovate the existing ranch house . The property is on a small lot (two merged lots of a 1920 subdivision) located on the corner of Illinois Avenue and Medey Avenue, Mattituck. The homes in the neighborhood are similarly developed on undersized lots . The applicant has attempted to reduce the impact on the one adjacent property (now or formerly of Falabella) by placing the second floor addition to what is currently a breeze way. The existing garage will be renovated and converted into living space within the existing structure and the new garage has been set-off the side yard. The renovations to the existing house will be limited, additional living space has been designed. The set backs of the existing house are nonconforming to Illinois Avenue. However, the distance to the road is approximately 50 feet due to a LIPA easement (Overhead wires) between the applicant' s property line and Illinois Avenue. This area is maintained by the applicant and the parcel appears to be larger then the actual metes and bounds of the parcel . 2 . The benefit sought by the applicant can not be achieved by some method, . feasible for the applicant to pursue, other than an area variance . The only addition beyond the footprint of the existing house is the connection between the existing garage and existing house, the new one story garage (storage space above the 4 garage) and covered porch needed to change the architectural style of the house from a "log cabin" look to a more contemporary farm house . 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance . The applicant has limited the expansion of the second floor to the areas of the existing structure . The existing house is a long ranch house on a corner lot, because the lot is small the lot coverage is exceeded with very little expansion of the footprint . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The neighborhood is developed and the only affected neighbor is to the east . The expansion on the east side of the property has been limited to one floor. 5 . The alleged difficulty was not self-created. The location of the existing house on the undersized corner lot create the difficulty. The applicant has tried to design a house which conforms in both size and design to the character of the neighborhood. The proposed additions update the existing house without changing the layout of the existing house . 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant .
