SAUNDERS Property Location: 1095 Franklinville Road, Laurel; CTM 125-2-3.1 and 4.1. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the north side of Franklinville Road, Laurel, and is improved with four buildings, shown on the April 3, 2003 lot-line change survey map, revised June 26, 2004 by John C. Ehlers, L.S. The maps shows that CTM Lot 3.1 consists of 14,268 sq. ft., and CTM Lot 4.1 consists of 20,448 sq. ft. BASIS OF APPLICATION: Building Department's January 20, 2004 Notice of Disapproval, citing Code Section 100-92 in its denial of a request for a lot-line change between CTM Lots 3.1 and 4.1. The code requires a minimum lot area of 20,000 sq. is required in the Hamlet Business (HB) Zone District, minimum single side yard setback of 10 feet, minimum total side yards at 25 feet, and maximum lot coverage of 40 percent. The reasons noted in the disapproval were: (1) a single side yard for the existing two-story building will be reduced from its present conforming (12 ft.) side yard to 5 feet; (2) the total sides will be reduced from its present 24 feet, to 17 feet; and (3) the size of CTM 3.1 will be reduced from 14,268 sq. ft. to 9,025 sq. ft. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: In the application, the applicant requested area variances in order to exchange a land area of 6,243 sq. ft. in this lot-line application and to allow increased building setbacks, as shown on the 2-26-03 map, revised 4-3-03 by John C. Ehlers, L.S. The original request for variances was as follows: (1) a single side yard for the existing two-story building (Lot A) would be reduced from its present conforming 12 ft. side yard to 5 feet; (2) the total side setbacks of the two-story building (Lot A) would be reduced from its present 24 feet, to 17 feet; and (3) the size of CTM 3.1 (Lot A) would be reduced from 14,268 sq. ft. to 9,025 sq. ft. ADDITIONAL INFORMATION:AMENDED RELIEF: During the June 22, 2004 public hearing, the applicant's attorney indicated that a change in the map was pending with the surveyor. On June 30, C ;-1 Rage 2—July 1,2004 ZBA No.5537—Joan A.Saunders CTM 125-3-3.1 and 4.1 2004, the maps revised 6-26-04 by John C. Ehlers, L.S. were submitted, showing a re-division as follows: (1) Lot A of 11,037 sq. ft. and 80.64 ft. road frontage, (2) Lot B of 23,679 sq. ft. with 131.04 ft. road frontage, resulting in an exchange of only 3,231 sq. feet. The side setbacks for the existing two-story building and the restaurant building (those closest to the division line) were also changed to show an increase with conformity to the code requirements for total sides of at least 25 feet, and at least 10 feet on any single side yard. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Both lots have been developed for many years in this business zone district. The exchange of property will provide for control of the parking lot by the restaurant landowner, rather than the parking being located on part of the adjacent lot. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. There is no other land area available to achieve these intentions. 3. Although Lot B will be increased in size by 3,231 sq. ft., the variance is substantial, representing a reduction of 3,231 sq. ft. of Lot A. 4. The difficulty is self-created and is based on the placement of the existing buildings and size of the property in nonconformity with the code requirements. 5. No evidence has been submitted to suggest that a variance in this community of commercial uses will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an exchange of land area, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the map revised 6-26-04 by John C. Ehlers, L.S.
