The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. According to the May 27, 2004 survey prepared by Peconic Surveyors, the entire parcel contains 3.915 acres, and the land cannot be subdivided without a variance because 12,138+-square feet are underwater. 3. The variance granted herein is substantial, representing 27% decrease in total lot area and an approximately 30% reduction from the code-required lot area of 80,000 square feet. 4. The difficulty was self-created. 5. No evidence has been submitted to suggest that a variance in this community of single-family residences will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the change in division, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Tortora, and duly carried, to GRANT the variance as applied for, as shown on August 2, 2004 amended survey by Peconic Surveyors, P.C., SUBJECT TO THE FOLLOWING CONDITION: The total lot coverage for Lot 1 (108,684 sq. ft.) is restricted to the total amount that is allowable for the original lot size of 85,265 square feet. To clarify, the total allowable lot coverage for a 85,265 sq. ft. lot is 17,053 sq. ft.; therefore, the total lot coverage for the new Lot 1 will be 17,053 sq. ft. as a condition of this variance approval. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
