The New York District, Corps of Engineers has received an application for a Department of the
Army permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403).
APPLICANT: Robert R. Wieczorek II
385 Gull Pond Lane
Greenport, NY 11944
ACTIVITY: Replace bulkhead and dredge with ten years maintenance and upland disposal
WATERWAY: Fordham Canal, Shelter Island Sound
LOCATION: Greenport, Town of Southold, Suffolk County, New York
A detailed description and plans of the applicant's activity are enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact,
including cumulative impacts, of the proposed activity on the public interest. That decision will reflect
the national concern for both protection and utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will be considered including
the cumulative effects thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and,
in general, the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies
and officials; Indian Tribes; and other interested parties in order to consider and' evaluate the impacts of
this proposed activity. Any comments received will be considered by the Corps of Engineers to determine
whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties, water quality, general
environmental effects, and the other public interest factors listed above. Comments are used in
preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the
National Environmental Policy Act. Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN
WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS
NOTICE, otherwise, it will be presumed that there are no objections to the activity.

WORK DESCRIPTION
The applicant, Robert R. Wieczorek II, has requested Department of the Army authorization to
replace a bulkhead and dredge material from Fordham Canal, Shelter Island at Greenport, Town
of Southold, Suffolk County, New York with ten years maintenance and subsequent upland
disposal.
The work would involve replacement of approximately 140 linear feet of existing timber
bulkhead in-place with C-Loc vinyl and dredging, with ten years maintenance, of material up
to 10 feet seaward of the bulkhead to a maximum depth of 6 feet below mean low water,
removing approximately 100 cubic yards on an initial basis. Approximately 25 cubic yards of
the material would be used as backfill behind the new bulkhead while the remainder from initial
and subsequent maintenance dredging would be disposed of at a state-approved upland location
where it would be suitably retained so as to prevent reentry into any waterway. Additional
dredging events are expected to involve approximately 30 cubic yards of material.
The stated purpose of this project is to prevent erosion and provide an adequate mooring facility.

Gentlemen:
The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on March 21, 2001, regarding the above matter
WHEREAS, Susan E. Long Pennits on behalf of ROBERT WIECZOREK II applied to the
Southold Town Trustees for a pennit under the provisions of the Wetland Ordinance of the Town
of South old, application dated March 1,2001 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
March 21, 2001 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare ofthe people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of ROBERT WIECZOREK
II, for a 140 bulkhead use C-Loc Vinyl in place reclaim 100 cy +/-Iost fill crom 10'x140' area
in cront of existing bulkhead to a depth of -6.0' at ALW. Replace existing 5'x140' walkway
with 8'x140' walkway with attached 12'x25' timber deck and access steps. Reconstruct upper
retaining wall landward of new walkway - and deck. Approximately 20-25 cy. reclaimed
material to be used as back fill .remainder to be trucked off site to approved upland site. There is
no dredging to be done. We will re- inspect before backfilling takes place after construction of
the bulkhead. In case there is any dredging has to be done or reclaimed fill.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency which may also have an application pending for the
same or similar project.
Permit to construct project will expire two years crom the date it is signed. Fees must be paid, if
applicable, and permit issued within six months of the date ofthis notification.

Two inspections are required and the Trustees are to be notified when project is started and on

At the meeting of the Southold Town ConserVation Advisory Council held Monday,
March 19, 2001, the following recommendation was made:
Moved by Scott Hilary, seconded by Bob Ghosio, it was
RESOLVED to recommend to the Southold Town Board ofTrustees APPROvAL WITH
A STIPULATION of the Wetland Permit Application of ROBERT WIECZOREK III 35-4-
28.26 to reconstruct 140' bulkhead using C-Loc vinyl inplace (Grandfather Permit
#5127). RESOLVED to recommend DISAPPROVAL to reclaim 100 cy. of lost fill from
10'X 140' area in front of existing bulkhead to a depth of 6.0' at ALW. Replace existing
5'X 140' walkway with upper retaining wall landward of new walkway and deck. Approx.
20-25 cy. of reclaimed material to be used as backfill and remainder to be trucked off
site to approved upland site.

The CAC recommends Approval of the application with the Stipulation that a non-turf
buffer is established and that the walkway is replaced with a non-turf buffer. The CAC
recommends Disapproval of the request to reclaim lost fill.
