Dear Mr. Henry:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 24,2001 regarding the above matter:
WHEREAS, JOHN B. HENRY applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold, application dated October 2,
2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recatnmeDdadefis,md,
WHEREAS, a Public Hearing was held by th~ Town Trustees with respect to said application on
October 24,2001, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the SO'lthold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare ofthe people ofthe town,
NOW THEREFORE BE IT,

RESOLVED, that the Board of Trustees approve the application of JOHN B. HENRY to install
two new cesspools on the landward side of the dwelling, as depicted on the survey received in
the office on October 2, 2001.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years ITom the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are require-d and the Trustees are to be notified upon completion of said pfuject. ---

CONSER V ATION ADVlSORY COUNCIL
At the meeting of the Southold Town Conseniation Advisory Council held Monday,
October 15, 2001, the following recommendation was made:
Moved by Drew Dillingham, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Wetland Permit Application of JOHN B. HENRY to install a new cesspool. -
Located: 2360 Village Lane, Orient. SCTM#26-1-15.1
The CAC recommends Disapproval because of concerns with the existing leaching
problem as noted by the applicant. The CAC questions if the new cesspool will alleviate
the existing problems.
Vote of Council: Ayes: All
Motion Carried

Enclosed, please find a check for $50 representing my application fee for
a permit to build a new cesspool on waterfront property I own at 2360 Village
Lane, Orient. The town board's hearing on the permit is scheduled for Oct. 24.
Also enclosed are postal cards as evidence that neighboring property
owners have received certified mail advising them of my plan to build a new
cesspool.
I posted the official Board of Trustees poster on the Oct. 24 hearing on
Oct. 14, and once eight days have elapsed from yesterday, I will send you by
Federal Express a notarized affidavit swearing that the poster has remained in
place during that period.

the building permit the Town of Southold board recently granted me for work I
plan to have done on my property at 2360 Village Lane in Orient. I understand
that the permit was granted after an Oct. 24 hearing on my application to build a
