Box 1179 Southold, New York 11971 Telephone (516) 765-18f2 Fax (516) 765-1823 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD March 26, 1998 William & Millicent Tufano 35 Ryder Ave. Huntington, NY 11746 Re: SCTM *122-9-9.6 Dear Mr. Tufano, The following action was taken by the Board of Town Trustees during its Regular Meeting held on March 25, 1998, regarding the above matter: WHEREAS, WILLIAM & MILLICENT TUFANO, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated February 2, 1998 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 25, 1998, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southo1d Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, . . RESOLVED, that the Board of Trustees approves the application of WILLIAM & MILLICENT TUFANO to remove existing house and construct a new house in a new location as per plans dated January 29, 1998, with condition that a non-turf non-ferti~ized buffer area be maintained in front of house towards the Bay. NOTE: Septic system not on survey, out of wetland jurisdiction. Located: 2482 Camp Mineola Road, Mattituck. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete proiect will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Subject: W &M Tufano SCTM #1000-122-9-7.6 To the Board: I am most concerned about the proposal of my neighbor W&M Tufano to build a house and garage - reference #1000-122-9-7.6. My main concern has to do with the size and use of the building labeled "proposed garage." Past experience with W&M Tufano indicates to me that their "proposed" use and the actual use will probably be quite different. My specific concerns are: 1. What is the height of this ''proposed'' garage? Does it contain a "second story?" If it does - then how will the town ensure that this second story will not be used as a residence? 2. Since this is a ''proposed'' garage - how can the town prevent thc entire structure fTom being used as a residence? 3. What recourse exists if the structure is built as a garage - and laler is modified to be a residence? 4. The size of this ''proposed'' garage is enormous! One thousand square feel (1000) if one story and two thousand square feet (2000) if two stories - this is larger than their entire current residence! This leads me to believe their intended use is well beyond that of a garage.
