1. That the said Board of Trustees and the Town of Southold are released from any and
aU damages, or claims for damages, of suits arising directly or indirecdy II a reosu.1t of any oper-
atinn performed punuant to this permit, and the said Permittee will, at his or her oom expense,
defend any and all such suits· initiaœd by third parties, and the said Permittee a__ full liability
with respect thereto, to the complete exclusion of the Board of Trusœes of the Toom of Soathold

apon due notice, to remove or alter this work or project herein stated without ezpenses to the Town

Dear Mrs. Mesiano:
The following action was taken by the Board of Town Trustees
during its regular meeting held on February 24, 2000 regarding
the above matter:
WHEREAS, Catherine Mesiano on behalf of RAPLH & TERRELL KAPLAN
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated December 29, 1999, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on February 24, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
RALPH & TERRELL KAPLAN to construct a 4'X 24' timber walk, to be
elevated a min. of 3.5' above grade, and 4'X 8' steps.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.
Fees: $240.00

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Tuesday, January 18,
2000, the following recommendation was made:
Moved by Bill McDermott, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION of the Wetland Permit Application of RALPH & TERRELL KAPLAN 116-
4-15 to install a fixed timber walk 4'X 24' to be elevated a min. of3.5' above grade; 3'X 14'
ramp; 8'X 16' float on 6" diameter low-profile piles. Access to dock proposed is 6' wide wood
chip path, 25' long.

The CAC recommends Approval with the Stipulation that the structure be minimized for
required water depth.

Gentlemen:
The enclosed application for a Trustee Lands Permit is being submitted on behalf
of Ralph and Terrel Kaplan, owners of the above referenced property. The
applicants propose to construct a 4' x 24' fixed timber walk, 3' x 14' ramp and 8' x
16' float on low profile piles to be accessed by a 6' x 25' wood chip.
