lowing:
1. 1ñat the said Board of Trustees and the Town of Soulhold aœ released from my and
aU damages, or claims for damages, of suirs arising directly or indirecdy as a result of my oper·
ation perfoaned punuant to this permit, and the aid Permittee will, at his or her own expeøse,
defend any and all such suits' iaiciated by third parties, and Ihe said Permittee .......... fall liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold

herein autborired.
6. That there shall be DO interference with the right of the puhüc to pass and repass along
Ihe beach between high and low water marks.
7. That if future operations of the Town of Southold require Ihe removal and/or alterations
in the location of the work herein anthorlzed, or if, in the opiaion of Ihe Board of Trustees, the ,
work shall cause unreasonable obsttuctlon to free navigation, the said PemWtee will be required,
upon due notice, to remove or alter this work or project herein sttted withour ezpeoses to the Towa
of Southold.

Dear Mr. Hepensteil:
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 25, 2000 regarding
the above matter:
WHEREAS, HAROLD HEPENSTEIL applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated September 20, 2000, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 25, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
HAROLD HEPENSTEIL for the alteration and renovations to the
existing dwelling with the condition that drywells be installed
and a row of haybales be placed down seaward of the excavation
area.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Mr. Krupski:
With regard to the attached rough sketch, would this project be eligible for
a Letter of Non-Jurisdiction. Although the owner is proposing to build up - over
the existing footprint, there may be a slight overcut of 3 or 4 ft. for a new 3-ft.
deep foundation under the existing deck area. The existing deck would be
removed, and no new building area is proposed seaward of the existing deck.
If an inspection fee or any other documents are necessary, we will be
happy to provide it.

January 18, 1996 and last revised September 15, 2000, and
determined the construction of a garage on the west side of the'
house to be out of the Wetland jurisdiction, under Chapter 97 of
the Town Wetland Code.
However, any activity within 100' of the Wetland line would
require a permit from this office.
This determination is not a determination from any other agency.
