RESOLVED, that the Southold Town Board of Trustees grant the request for a Waiver to AQUAVIEW HOMEOWNERS ASSOC. INC. C/O WILLIAM A. GEROSA to install a temporary "barrier" type fence with sign on the west and east property lines of the Aquaview Homeowner's Association, Inc. The homeowners association wished to install iron stanchions with a light chain linking each stanchion fi.om Memorial Day to Labor Day. Suspended fi.om each chain will be a sign that states "private property" with the conditions that after Labor Day chain to be removed not the iron stanchions. This approval does not constitute approvals from any other agency. If you have any questions, please call our office at 765-1892. Please note that the former placement of the iron stanchions on the beach is noted on the survey. However, the surveyor has also placed wooden stakes on the property line and it is these stakes that will be used by the owners to locate the signs for which a waiver has been requested. Please advise your decision in this matter. The ticket for the violation involved in this matter is scheduled to be heard on February 16th. I would appreciate your advising if a decision will not be rendered by that time so I may request a further adjournment in Court. Also enclosed please find two photographs of the fence that was previously at the site and which is proposed in the above request. Unfortunately, the right of way in question has not been surveyed since the initial subdivision. I am enclosing herewith a copy of the only survey in my file regarding this property. There has never been a need to have a new survey prepared and certainly there will be none in the future since no construction will take place on the right of way. For your information, I am enclosing a copy of a survey of the adjacent parcel now owned by my client William Gerosa who is the President of the Aquaview Property Owners Association, Inc. Box 117~ Southold, NY 11971 Re: Request for A Waiver Dear Sir/Madam: My clients, Aquaview Property Owners Association, William Gerosa, Maria Bulis and Dorothy Crawford, are owners of three adjacent parcels of land on Aquaview Avenue (SCTM #1000/21/2/5.1, 6 and 7. On September 6, 2000 a summons was issued to William Gerosa (parcel 5.1) and Bulis and Crawford (parcel 7) for a violation of Section 97-201. ]'he Notice of Violation dated September 11, 2000 refers to a fence within 75 feet of a wetland that was erected without a Trustee permit. This matter was scheduled to be heard in Justice Court on September 29th, but upon consent has been adjourned to October 25, 2000. The "fence" in question is temporary in nature in that it is erected each Memorial Day and removed on Labor Day. In fact the "fence" in question had already been removed on the date the summons was issued. The summonses, additionally, were issued to William Geroa (parcel 5.1) and Bulis and Crawford (parcel 7) in error since the "fence" was erected on the property of Aquaview Property Owners Association (parcel 6) on its property lines with parcel #5.1 (Gerosa) and parcel #7 (Bulis and Crawford). Applicants seek permission to erect, on a temporary basis each year, "fencing" on either side of parcel #6 (as described on the notice to adjacent property owners, the "fencing" on both sides to hold a sign that states "Private Property." The light chain will be erected each year on Memorial Day weekend and removed each year on Labor Day weekend (original Request and Notice attached hereto).
