Wetland Permit to construct a 4' X 15' catwalk, a 3' X 14' ramp·
and a 6' X 20: float secured with two 8" in diameter pilings. .,
all in accordance with the detailed specifications as presented in
the originating application.

Dear Mr. Haje,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on May 26, 1999, regarding the
above matter:
WHEREAS,
Trustees
Ordinance
1998 and,
ERIC & MARIE MUNTNER, applied to the Southold Town
for a permit under the provisions of the Wetland
of the Town of Southold, application dated April 21,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 26, 1999, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
ERIC & MARIE MUNTNER to construct a 4' X 15' catwalk, a 3' X 14'
ramp and a 6' X 20' float secured with two 8" in diameter
pilings.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete prolect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Mr, Krupski:
I am writing in response to a copy of a letter to the Board we received, prepared by Harold Wilsberg and
dated 2 May 1999, and to correct an error on our project plan identified by Mr, Wilsberg's letter.
First, Mr, Wilsberg's letter indicates the width of James Creek in this location to be 100', while our
project plan depicts a width of ±250', To correct the creek width shown on our plan, which was scaled
inaccurately ITom a 1":3000' map, we conducted a field measurement of the creek on 7 May 1999, which
revealed an actual width of±120', Because the proposed dock would extend a distance 38' seaward of
the line of apparent high water, however, the dock would still extend a distance less than 1/3 of the width
of the creek
The purpose of the proposed specifications of the dock is not to accommodate a large boat, however, but
rather to accommodate the new dock policies of the New York State Department of Environmental
Conservation (NYSDEC), which require the terminus of floating docks to be situated in no less than -
4' ALW, As we have discussed, reaching such water depth at low tide is virtually impossible in the Town
of Southold, a dilemma that has brought the environmental permit process for docks to its knees during
the past year.
In ITont of the Muntner's property, however, there is a sudden drop in water depth close to the shore,
which should allow the proposed dock to meet the policies of both the Town and the NYSDEC.
Specifically, while there is merely a depth of -2'-2"ALW at a distance 18' seaward of the low water line,
there is a water depth of -4' -6" at a distance 28' seaward of the low water line, Therefore, there is a gain
of almost 2,5' of water depth over a horizontal distance of 10'. It is difficult for me to justifY how 10' of
dock would be significant enough to create another irreconcilable situation between the NYSDEC and
local jurisdiction, absent adverse environmental impacts,

Dear sirs,
I have received a map and description of a proposed private floating dock for Eric Muntner,
4210 Olejule Lane, Mattituck I am the adjacent property owner on the east side and I have no
objection to Mr.Muntner constructing a floating dock on his property if kept near his shore line, I
do object to the one he is filing a permit for which extends over 40 ft, from the shorelinlfinto the
creek By the time he ties his boat to the outside of the float, it will be over 50ft,
The creek at this point at MLW is only approximately 70 ft, wide and would obstruct boats
passing. His plan calls for 4'6" of water at MLW at his float which is totally not necessary, as
there are two sections of the channel leading into James Creek that now have only 2 to 21/2' of
water at MLW.
Ifhe owns a boat drawing more than 21/2 ft,ofwater he would be unable to get out into the
main channel at ML W.
