Dear Mr. Herrmann,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on March 24, 1999, regarding the
above matter:
WHEREAS, JOANNE BLUM & WILLIAM SCHAEDEL, applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated
March 1, 1999 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 24, 1999, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
JOANNE BLUM & WILLIAM SCHAEDEL to replace 182' of existing
bulkhead inkind/inplace and dredge up to 10' off boat slip to a
max. depth of -3' at ALW and use approx. 63 c.y. of spoil for
backfill, as indicated on new drawings and description received
in this office on April 12, 1999, and that the boat be tied
inside the boat slip, and a 10' non-turf, non-fertilized buffer
be maintained all around bulkhead. Located: 3820 Ole Jule Lane,
Mattituck.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete proiect will expire two JLears
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Pursuant to the Board's request during the public hearing for the captioned application on March
24, 1999, please find attached (3) copies of a project plan revised to depict the 52' of bulkhead
rronting James Creek proper to be replaced in-kind and in-place, As a result, all 182' of
bulkheading will be replaced in-kind and in-place,
The applicants understand that the Board members would not permit the replacement of these
sections of bulkhead within 18" because they do not want this relatively narrow section of creek
to be further narrowed,
By copy of this letter and plans, I am requesting that the NYSDEC and Army Corps of Engineers
amend their permits accordingly,

At the meeting of the Southold Town Conservation Advisory Council held Tuesday, March 23,
1999 the following recommendation was made:
Moved by Richard Smith, seconded by Melvyn Morris, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of JOANNE BLUM AND WILLIAM SCHAEDEL 122-4-25 to
replace (within 18") +/- 52' of existing timber bulkhead, and remove and replace (inkind/inplace)
+1- 157' of existing timber bulkhead, Dredge up to 10' offboat slip bulkheading to a maximum
depth of3' ALW and use approx, 63 c,y, of resultant spoil as backfill.

Dear Board of Trustees:
Basically, my wife and I have no objection to the proposed work
as detailed.
However, we have serious concerns that may arise in the future.
BACKGROUND
1. To reach or leave our property by water at low tide in a moderate
size boat (16 to 30 ft. long, drawing 11 to 3 ft. of water)
there is only one course, and that is to pass in front of the
west section of the bulkhead under discussion, make a hard
(less than 900) turn to the outgoing channel past Strong's
Marina, which is also very narrow.
2. Navigable water for a moderate size boat extends a little more
than half way from the bulkhead under discussion to the bog
island immediately across the creek (to the south). That is,
the water is only deep enough about 20 feet from the bulkhead.
The remaining distance of about 10 feet shoals up fast to the
bog island.
THE CONCERN
1. The 18" less navigable channel width after the proposed
bulkhead is completed is not a major concern. However, if in
the near or distant future, the present or future owner(s)
place a boat (tied up) to that section of bulkhead (west end,
on the creek), navigation of the channel at low tide will be
extremely difficult if not impractical, thereby denying access
to our property by water in a moderate size boat. If the
present or future owners place a floating dock in front of
the same section, the problem will be almost as severe or
worse, if a boat is placed (tied up to) the floating dock.
2. It could be said we could reach our property from the west;
however, the water is shallower in front of the adjacent
property than in front of the proposed bulkhead.
3. Can and would the Board of Trustees assure us access to our
property by water against blockage by a floating dock and/or
a boat placed on the west section of the proposed bulkhead?

FURTHER BACKGROUND
For the record, I placed my bulkhead returns one foot inside
my property survey markers, just to allow me access to the
wood work if repairs were ever needed. I noticed a newly
painted survey mark is just adjacent to my outboard spiling
which means the surveyors are off a few inches and/or I was
off a few inches--no real problem as of now. Also for the
record, neither Mrs. Edna Schaedel nor anyone else has asked
if she may (re)attach her new bulkhead to my return, which was
installed several years before her bulkhead. She did mention
last summer she was planning on redoing the slip. Again--no
big problem, as long as she or future owners don't try to claim
the return as their own.
