That if furore operations of the Town of Soutbuld require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Bòard of Trustees, the work shaU cause unreasonable obstruction to free navigation, the said Pennittee will be required. upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold. NOW THEREFORE BE IT, RESOLVED, that the' Board of Trustees approved the application of CHARLES & BARBARA BRIENZA to extend the rock revetment 40'. BE IT FURTHER RESOLVED, that this dete"mination should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two vears from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. The excavation needed to install the revetment will unsteady approximately 1,000 square feet of beach that is not exhibitin~ the characteristics of erosion but is accretIng at this time. The construction of the proposed revetment WIll have an undue adverse impact on approximately 1,000 square feet of wildlife habitat consisting of sand and cobble beach which is utilized by shore birds for nesting and foraging and horseshoe crabs for spawning. According to 6 NYCRR Part 661.9(b)(3) and Part 661.9(c)(3), the proposed activity must be reasonable and necessary taking into account reasonable alternatives and that the proposed activity will not have an undue adverse impact on the present and potential values of any adjacent or nearby tidal wetland for marine food production and wildlife habitat. A reasonable alternative is the installation of toe annor along the beach/embankment interface. A Ii.ne of stone, five ton minimum, placed side by side across the entire property would be authorized for this sIte. It has recently come to my attention that you have requested a jurisdictional inquiry for the above mentioned property for the construction of a sin~e-family dwelling. Multiple a{lplications for proposed activities occurrin~ at a single property are consIdered by this Department as a smgle action. Therefore, the jurisdictional inquny request for the proposed dwelling will be combined with the application for the proposed revetment. The Department's technical staff already field inspected the location of the proposed revetment, but now may have to revisit the site due to the jurisdictional inquity.
