Box 1179 Southold, New York 11971 Telephone (516) 765-18~2 Fax (516) 765-1823 BOARD OF TOWN TRUSTEES TOWN OF SOUTH OLD February 25, 1999 Mr. Robert Herrmann En-Consultants, Inc. 1329 North Sea road Southampton, NY 11968 Re: Eileen Kasschau SCTM#118-1-1.2 Dear Mr. Herrmann: The following action was taken by the Board of Town Trustees during its regular meeting held on February 24, 1999 regarding the above matter: WHEREAS, En-Consultants on behalf of EILEEN KASSCHAU applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated February 3, 1999 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 24, 1999, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, . . WHEREAS, the Board has determined that will not affect the health, safety and people of the town, the project as proposed general welfare of the NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees grant a Wetland Permit to replace (within 18") +/-160' of existing timber bulkhead and backfill with approx. 135 c.y. of clean sand trucked in from an upland source. Remove and replace (inkind/inplace) existing 7'X 8' frame shed¡ 6'X 20' wood deck¡ 3'X 7' wood steps and +/- 160' timber retaining wall. Shed is to be used as a shed only and area is to be revegetated. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Nassau Point, Cutchogue. For the purpose of clarification. we offer the following points of information; · The original bulkhead and retaining wall spannil1g the Kasschau's current property and a portion of our property are each of one piece, as this whole segment of land at the timc of their construction belonged in cntirety to Ùle property now owned by the Kasschau's (It was deeded to our property in 1962.); · The groin shown in Figure 1 and described as "on the west side of westerly property line" is beyond the Kasschau's property line and extends from our property; and · The three leaning pilings shown in Figure 2 are on our property. (The property line can be easily distinguished as the previous owner of our property, Carl Hobnhorst, had his portion of the bulkhead repaired and the pilings are of a different color and configuration.)
