Box 1179 Southold, New York 11971 Telephone (516) 765-1892 Fax (516) 765-1823 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD May 29, 1998 En-Consultants, Inc. 1329 North Sea Road Southampton, NY 11968 Re: Charles & Janice Bovino SCTM #119-1-5 & 6 Dear Mr. Herman: The following action was taken by the Board of Town Trustees during its regular meeting held on May 28, 1998 regarding the above matter: WHEREAS, En-Consultants on behalf of CHARLES & JANICE BOVINO applied to the Southo1d Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated March 23, 1998, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 28, 1998, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, . . RESOLVED, that the Board of Trustees grant a Wetland Permit to to construct a 200+/-' secondary retaining wall with (2) 10' returns, remove existing stairs on North side of the property and construct new stairs on south side of property consisting of (3) 9' X 13' sitting areas and a 10' X 30' deck between existing wall and proposed wall with adequate spacing in between planks for drainage off decks, a 50' wall to be installed on north side of property towards top of bank approx. 5' from property line and no higher than 6', also to bring in approx. 225 c.y. of clean fill and replant entire bank. As per plan dated May 20, 1998 of Samuels & Steelman Arch. Located Nassau Point Road, Cutchogue, and BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. NASSAU POINT Members of the Board, Attached please find (3) prints of a comprehensive bluff stabilization plan for Mr. Bovino, prepared by Samuels and Steelman, in order to combine the two separate but interdependent proposals submitted to the Board. The plan includes the proposed secondary timber retaining wall, as well as a grading and plantings plan for the entire bluff face. Although I have dictated the species to be planted, we of course welcome any other suggestions the Board may have. I look forward to concluding this matter at the public hearing scheduled for May 28th, which will also be attended by Tom Samuels, Sr. and Tom Samuels, Jr. - Robert E. Box 728 Southold New York 11971 RE: Bovino Residence Permit #4914 Dear Trustees: On May 29, 1998 you granted a permit as per a plan prepared by our office, dated May 20, 1998. Unfortunately, I believe our SITE PLAN was mis-read, where a five foot (5'-0") dimension indicates the setback of a retaining wall from the property line. In writing the permit you included a setback dimension of seven feet (1'-0"), which the plan shows as the length of the return of the wall into the bank. I would like to clear this up by stating that we intend to locate the wall five feet (5'-0") from the property line, as per our approved plan. Please let us know if this requires any action on your part. Additionally, we would like to amend the permit to enlarge the deck shown between the pre-existing bulkhead and the new upper level bulkhead (recently completed). We would like your approval to lengthen that deck to forty feet (40'-0"), and state the width "as required to infill between the two bulkheads", approximately thirteen feet (13'-0").
