Specifically, the proposed 4' wide catwalk has been reduced in length ITom 68' to 61' so that the entire dock structure will extend no more than 45' seaward of the seaward edge of intertidal marsh and line of apparent low water. The proposed dock would therefore be consistent in scope and character with the adjacent dock to the east of the Quinn property. As we discussed, it is our expectation that the Board will again contact the New York State Department of Environmental Conservation (DEe) directly to advise them of the Trustees' decision and special conditions with the hope that the DEC would be willing to issue a similar permit. On July 28,1999, Department staff conducted a site inspection at the above referenced property at which time water depth measurements were taken at low tide. It was determined that the proposed float will be located at a depth of only 2.2' referenced to apparent low water. Because of the shallow conditions of the mooring area, a boat would sit on the bottom at low tide conditions and to gain access to and/or leave the dock would result in "prop" dredging of the bottom habitat. The lack of water depth would also give rise to the potential for future dredging of this bottom habitat. Any vessels berthed at this proposed location would continually chum up and destroy the valuable benthic habitat causing adverse impacts to the existing and potential values of this tidal wetland (mudflat/littoral zone) and adjacent vegetated wetlands (intertidal marsh) for marine food production and wildlife habitat, as well as other values associated with tidal wetlands. Further, the proposed dock is not reasonable and necessary. Since the site is so shallow, a boat would not be able to safely dock at this facility. Extension of the dock seaward enough to obtain sufficient water depths would result in a structure extending further seaward than other docks in the area. However, to provide a balance between reasonable water access and impacts to the tidal wetlands, we could approve a 4' by 12' ramp landward of the tidal wetland boundary (as shown on the current site plan) and a 4' by 40' fixed catwalk extending over the vegetated tidal wetlands. A dinghy or similar small craft could be kept at the seaward end of the catwalk to provide access to a larger boat moored offshore. First, the applicants respectfully request that the Board of Trustees grant them an ext-·;'\MIt&,thetime' atlowEö ror paying tåe')ç..~l feet for their approved docks, pending a decision by the New York State Department of Environmental Conservation (DEC). Secondly, I would ask you again to make an attempt ao.. ði"C"~" with DEe staft' thd' reconciliation of their dock permitting process with your Board's. For your reference, I enclose herewith copies of the DEC's letters of denial on both tidal wetland applications for the docks your Board approved unanimously in June and July. Please note that while the environmental conditions of both sites are virtually identical with regard to adjacent wetlands; water depths; and similar neighboring docks, the DEC rendered two completely different decisions on each dock. Specifically, while they appear willing to approve a catwalk to the water for the Quinns, they appear unwilling to approve any structure whatsoever for the Seiferths, recommending a "piling and pulley system" to the latter. Our office, other local agents, and indeed other local governing boards such as the Town of Southampton Trustees and Town of Shelter Island CAC (as reported several months ago in the Shelter Island Reporter) remain befuddled at these stated "alternatives". It of course seems irrational to almost everyone that the DEC would deny the construction of a dock because the associated boat use will cause "prop dredging", but then offer an alternative system designed to allow the same boat use in the same area in which the dock was proposed. The situation becomes more difficult to understand when numerous docks approved by the DEC, often as recently as last year, continue to be built in front of surrounding properties, and there has been no change in Tidal Wetlands Land Use Regulations 6 NYCRR Part 661.5(b), which states that "constructing one open pile catwalk and/or dock not greater than four feet in width for any principal building" over and adjacent to tidal wetlands is a "generally compatible use." · 'i'Î Albert J.
