Dear Mr. Blackley:
The following action was taken by the Board of Town Trustees
during its regular meeting held on August 25, 1999 regarding the
above matter:
WHEREAS, JAMES BLACKLEY applied to the $outhold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated July 21, 1999, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on August 25, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
JAMES BLACKLEY for a 3'X 30' catwalk with the condition that the
existing structure be removed.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Thursday, August 12,
1999, the following recommendation was made:
Moved by Scott Hilary, seconded by Ken Meskill, it was RESOLVED to recommend to the
Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of
JAMES BLACKLEY 117-1-13 & 117-4-5 for a re-built dock consisting ora 5'X 30' dock, a
5'X 6' catwalk, and a 5'X 10"float with 4" pilings, and, construct a 10'X 32' deck on the front
of the house.

The CAC recommends Disapproval because of the following reasons:
1. The structure would have an adverse affect on the wetlands.
2. There is no need shown.
3. Creek access exists at the Town ramp for small boat use.
The CAC further recommends removal of the structure.
The deck is non-jurisdictional.

we replaced a dock that was in disrepair. As part of our permit process we've been asked to notify our

This letter is in response to the attached Notice Of Violation dated April 21, 1999, received by
registered mail on April 24, 1999. According to the Notice of Violation I have inadvertently violated a
town ordinance by failing to obtain a Trustee Permit prior to beginning refurbishment of the dock at my
New Suffolk home.
I am confused in regard to this issue because I thought I had followed the Southold Town Clerk's
instructions to the letter and had fulfilled all required procedures. In January I contacted the Southold
Town Clerk and explained that I had recently purchased a home in New Suffolk and that the house had
an existing dock which was in dangerous condition. I mentioned I had a copy of the original dock
permit (which was "gmndfathered" according to our lawyer at the time we closed) and that I wanted to
return the dock to specification. I was told that this should not present a problem and was instructed to
submit a Xerox copy of the original dock permit with a survey of the property and a letter spelling out
my intentions. I was .told that the documents would be reviewed and if anything was amiss, I would be
contacted. If ! was not contacted, I could assume I had de-facto permission to proceed.
You'll note from the documents attached that I did exactly as I was instructed and submitted the
required original permit, survey and a letter detailing my intentions on February 1, 1999. I was not
contacted from/by the Board of Trustees in any fashion and assumed I had permission to proceed. I
started re-construction of the dock this April.
If, I have in fact violated a town ordinance, I did not do so intentionally. If you still feel that it is
necessary I would very much appreciate an opportunity to apply for a hearing before the Board of
Trustees of the Town of Southold to come and explain my situation in person.

This letter is intended to inform you that we will be repah-'ing our dock at our residence 1455 Grathwohl
Rd., New Suffolk, NY. Attached is a copy of the original permit. We do not intend to alter the dock in
any way and will repair it in accordance with the dimensions and specifications in this original permit. We
hope to begin work early in the spring of this year.
Based on a conversation I had with an employee in your office, this letter and copy of the permit should
satisfy all requirements for notification and approvaI to proceed with this repair work. If there is anything
