Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax (631) 765-1366 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD June 26, 2000 Mr. Dan Hall Land Use Ecological Services, Inc. 2576 Sound Ave. Baiting Hollow, NY 11933 Re: LAURENCE NIEBLING SCTM#1l9-l-l8 Dear Mr. Hall: The following action was taken by the Board of Town Trustees during its regular meeting held on June 21, 2000 regarding the above matter: WHEREAS, Land Use Ecological Services, Inc. on behalf of LAURENCE NIEBLING applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 17, 2000 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 21, 2000 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97 of the Southold Town Code, . . WHEREAS, the Board has determined that will not affect the health, safety and people of the town, the project as proposed general welfare of the NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of LAURENCE NIEBLING to install 100+/- cy. of 500-1000 lbs. stone along 1000 sf.+I- of existing bluff scarp. The stone is to be placed on filter fabric on a graded 1 on 2 slope, then back-filled to existing beach elevations/conditions. Installation not to exceed 3'+/- below existing beach grade. Remove existing timber stairs and install a 6'X 10' CCA timber platform with 4'X 15' CCA timber stairs as beach access. Proposed platform and stairs will be installed to match up to an existing concrete walk supported by 4"X 4" CCA timber posts with a depth of penetration of 6'+ with the condition that the exisitng concrete walk 18"+/- wide 70'+/- in length be removed and replaced with a 4' wide timber walkway with spaces between the timber to allow for drainage. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification, Two inspections are required and the Trustees are to be notified upon completion of said project. Excavation of the beach to construct a revetment could destabilize the embankment, causing slumping and sediment to enter the tidal wetland area. Excessive erosion problems are not evident, therefore, the proposed structure is excessive. The Department recommends 1-2 ton stones on filter cloth without any excavation below grade and a planting plan to supplement vegetation on the embankment. Upon receipt of revised plans/cross-section which clearly reflect our recommendations, the review process will continue. Niebling - Nassau Point Project Description: Applicant proposes to install 100 +/- cubic yards of 500-1 000 Ibs. stone along 1000 sJ. +/- of existing bluff scarp. The stone is proposed to be placed on filter fabric on a graded 1 on 2 slope, then backfilled to existing beach elevations / conditions. Proposed installation not to exceed 3'+/- below existing beach grade. Applicant also proposes to remove existing timber stairs and proposes to install a 6' x 10' CCA timber platform with a proposed 4' x 15' CCA timber stairs as beach access. Proposed platform and stairs are proposed to be installed to match up to an existing concrete walk and are proposed to be supported by 4" x 4" CCA timber posts with a depth of penetration of 6'+.
