Dear Ms. Wickham:
The Southold Town Board of Trustees reviewed the survey dated
April 15, 1999 and last revised October 19, 2000 and determined .
the proposed subdivision to be out of the Wetland jurisdiction
under Chapter 97 of the Town Wetland Code.
However, any activity within 100' of the Wetland line would
require a permit from this office.
This determination is not a determination from any other agency.
If you have any further questions, please do not hesitate to

Re: John Sidor Subdivision Application

Dear Trustees:
We are the attorneys for John Sidor, who owns the 22 acre farm on the south side of
Wickham Avenue, Mattituck, N.Y., opposite Wolf Pit Lake. Mr. Sidor is proposing a
subdivision of the property which has received conditional approval from the Planning
Board. The subdivision would create only two 2-acre building plots on Wickham
Avenue, and the remainder of the farm will be a single lot with 5 buildable acres on
County Road 48 and 13.296 acres of farmland with development rights sold to Southold
Town. Consequently, the density has been reduced to minimal proportions.
The Department of Health Services has questioned the proximity of the subdivision to
Wolf Pit Lake, and asked for a letter from the Trustees waiving jurisdiction or stating
their approval of the proposed subdivision. As the latter would require a wetlands permit
application, and at this point we are only subdividing and not building, I would like to
request a letter that you will not exercise jurisdiction on the subdivision.
Upon development of the lots, a driveway is likely to be the only structure within 100
feet of the wetlands, and will require review by your Board at that time. The Planning
Board has required a covenant that driveways entering on to Wickham Avenue be
constructed so as to prevent runoff onto the public road.
A copy of the map is enclosed. If you need additional information, please let me
know. Please advise.
