Box 1290 Mattituck NY 11952 Re: SCTM ~113-3-2.3 Dear Mr. Piraino, The following action was taken by the Board of Town Trustees during its regular meeting held on June 25, 1997, regarding the above matter: WHEREAS, ANTONIO PIRAINO, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated June 2, 1997, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 25, 1997, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, . . RESOLVED, that the Board of Trustees approves the application of .~ONIO PIRAINO to construct a two-story single family dwelling with provision that haybales be placed during construction, no directing of runoff over driveway, a pervious driveway be constructed and drywells be placed. Located: Cox Neck Road, Mattituck. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. . Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Over the course of the years we have lived here, we have observed a tremendous natural flow of runoft' water from our property down the clift'located on our eastern boundary of Lot # 16. Due to this runoft' we have taken precautionary measures to ensure the integrity of this boundary. These measures include the planting of numerous trees, shrubs. i\ y, and placement of railroad ties. On numerous occasions during our rainy seasons, we have witnessed the tlooding of the proposed building site. On one occasion the dirt road which starts at Cox Neck and winds its way along the bottom of the clift'was so tlooded that a car was abandoned trying to ride do\\n this access road because the water level was up to the door handles of the car. We are deeply concerned that the proposed building site will cause a tremendous amount of damage to the clift'. The removal of trees in order to build the proposed house will destroy the natural bulkhead that has been built up over the years we have lived here. This will undoubtedly lead to further erosion of the cliff. We are also very concerned about the location of the proposed septic system in relation to our water supply. As it is already well known that most of the homes on Rosewood Drive have tìltration systems because of the high level of aldycid trom tàrming, this septic system will only add more distress to an already distressed area. This can clearly be seen by the Test Hole which hits a sand water mixture at only 3.5 tèet. Having the septic system placed at the proposed site further increases the risk of intrusion of contaminants into our well water drinking supply. Even the proposed builders are having their water brought in trom Cox Neck for tèar of trying to drill their own water well We respectfully ask that the proposed building plan be rejected by the Board of Trustees of the Town of South old. In our view the proposed building site is completely un- realistic. Reason:(l): The map contour lines show a steep drop from 30' to 20' to 10'. thence to ground level,where water runs into the marsh.On any rainy day or wintersnow, the flood of water increases. Reason: (2): From an environmental aspect, the flow of water from our propertydown the steep incline,has been buttressed by shrubs trees and ground cover--which by our experience (fourteen years on this property) ,creates an extensive flooding, with the result that the pro- posed building site makes passage impossible. Reason: (3): On many occasions, my wife and I have witnessed many abortive attempts to use the existent road. People have had to abandon vehicles, and "hoof" it out as best they can. Reason:(4): TIle removal of the trees (natural barrier) and shrubs will not only obliterate this barrier but hasten the advent of mud slides as well as the proposed building site. Reason: (5): We, lot 14, have a GNS (mennaid) wate<,purifica- tion system. In addition, we also have a Rhone-Poulenc filtration sys- tem for purity of drinking water. The maintenance of the carbon filter is the obligation of Rhone-Poulenc under their agreement w~th Suffolk County. Each year the granular activated carbon filter is rebedded. Our concern is the proposed placement of the septic tank in relation ,to our ,;ater supply. Our well goes down 55' and aldicarb and ./ .. . . page two carbofuran are periodically checked out by the Health Department of Suffolk County. Because the water table varies , and the proposed septic tank's location is doubtful for our water supply, we are deeply con- cerned that seepage will contaminate ourwell.
