Tasker, Town Attorney Supervisor Murphy and moved its adoption: offered the following resolution RESOLUTION ADOPTING AN ORDER AUTHORIZING THE CONSTRUCTION OF A BUILDING TO BE USED FOR PUBLIC RESTROOMS AT FOUNDER'S LANDING PARK, IN THE SOUTHOLD PARK DISTRICT, IN THE TOWN OF $OUTHOLD, NEW YORK. · Recitals WHEREAS, the Board of Commissioners of the Southold Park District (the "Park District"), in the Town of Southold (the "Town"), in the County of Suffolk, New York, pursuant to resolution duly adopted and subscribed by said Board of Commissioners on May 29, 1985, and, together with a petition in due form, duly submitted to the Town Board of the Town (the "Town Board"), has requested the Town Board to appropriate $50,000 for the construction of a building to be u~ed for public restrooms at the existing Founder's Landing Park, in the Park District, and to finance such appropriation by the issuance of obligations of the Town in the principal amount of $50,000 pursuant to the Local Finance Law, and that to pay the principal of and interest on such obligations as the same shall become due and payable, a sum sufficient therefor shall be levied and collected from the several lots and parcels of land within the Park Dis%rict, in the same manner and at the same time as other Town charges; and further, that the Town Board call a special meeting of the Park District for the purposes of (i) holding a public hearing to hear all persons interested in such construction, appropriation and financing and (ii) voting upon a proposition therefor; and WHEREAS, pursuant to the Order of the Town Board dated June 18, 1985, a public hearing was duly called and held on the 16th day of July, 1985, at 4:30 o'clock P.M. (Prevailing Time), at the Southold Town Hall, Main Road, Southold, in the Town, at which time all persons interested were duly heard concerning such construction, appropriation and financing; and WHEREAS, at said meeting of the Town Board and following such public hearing there was submitted to the qualified voters of the Park District a proposition (set forth in said Order) for approval or disapproval of such construction, appropriation and financing and said proposition was duly approved by a majority of the qualified voters present and voting thereon; NOW, THEREFORE, BE IT RESOLVED, that the following Order be and the same is hereby adopted: At a regular meeting of the Town Board of the Town of Southold, in the County of Suffolk, New York, held at the Southold Town Hall, Main Street, Southold, in said Town, on the 30th day of July, 1985. The Town of $outhold, in the County of Suffolk, New York (herein called "Town"), hereby appropriates the amount of $50,000 for the construction of a building to be used for a public restroom at Founder's Landing Park in the $outhold Park District, in the Town, including purchase of the original furnishings, equipment, machinery and apparatus required in connection with the purpose for which said building is to be used. The estimated maximum cost of said specific object or purpose, including preliminary costs and costs incidental thereto and the financing thereof, is $50,000 and the plan of financing includes the issuance of $50,000 serial bonds of the Town to finance said appropriation, and the assessment, levy and collection from the several said park District, other Town charges, interest thereon as Section amount of $50,000, lots and/or parcels of land within in the same manner and at the same time as to pay the principal of said bonds and the the same shall become due and payable. 2. Serial bonds of the Town in the principal are hereby authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called "Law") to finance said appropriation. Section 3. The following additional matters are hereby determined and declared. (a) The proposed building is of Class as defined by Section 11.00 A. ll.(b) of the Law, of probable usefulness of said specific object or purpose for which said $50,000 serial bonds authorized pursuant to this resolution are to be issued, within the limitations of Section 11.00 a ll.(b) of the Law, is twenty (20) years. (b) Current funds are not required by the Law to be provided as a down payment prior to the issuance of the bonds authorized by this resolution or any bond anticipation notes issued in anticipation thereof in accordance with Section 107.00 d. 3(a) of the Law. (c) The proposed maturity of the bonds authorized by this resolution may exceed five (5) years. Section 4. Each of the bonds authorized by this resolution and any bond anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of validity "B" construction and the period as prescribed by Section 52.00 of the Law and said bonds and any notes issued in anticipation of said bonds, shall be general obligations of the Town, payable as to both principal and interest by general tax upon all the taxable real property Within the Town without limitation of rate or amount. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of and interest on said bonds and any notes issued in anticipation of the sale of said bonds and provision shall be made annually in the budget of the Town by appropriation for (a) the amortization and redemption of the bonds and any notes in anticipation thereof to mature in such year and (b) the payment of interest to be due and payable ~n such year. Section 5. Subject to the provisions of this resolution and of the Law and pursuant to the provisions of Section 30.00 relative to the authorization of the issuance of bond anticipation notes and of Section 50.00 and Sections 56.00 to 60.00 of the Law, the powers and duties of the Town Board relative to authorizing bond anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of the bonds herein authorized and of any bond anticipation notes issued in anticipation of said bonds, and the renewals of said notes, are hereby delegated to the Supervisor, the chief fiscal officer of the Town. Section 6. The validity of the bonds authorized by this resolution and of any notes issued in anticipation of the sale of said bonds, may be contested only if: (a) such obligations are authorized for an object or purpose for which the Town is not authorized to expend money, or (b) the provisions of law which should be complied with at the date of the publication of such resolution are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication, or (c) such obligations are authorized in violation of the provisions of the constitution. Section 7. This bond resolution shall take effect immediately, and the Town Clerk of the Town, is hereby authorized and directed to publish the foregoing resolution, in full, together with a Notice attached in substantially the form prescribed by §81.00 of the Law in "THE LONG ISLAND TRAVELER- MATTITUCK WATCHMAN," a newspaper published in Southhold, New York, and in "THE SUFFOLK TIMES," a newspaper published in Greenport, New York, each having a general circulation in the Town and hereby designated the official newspapers of said Town for such publication.
