part of the consideration for the issuance of the Permit does understand and pæscribe to the fol-
löwipg:
1. That the said Board of Trusteea and the Town of Southold aœ released from any and
. all damages, or claims for damages, of suits arising db:ectIy or Indirectly u a result of any oper-
ation performed pursuant to this permit, and the said Pemûttee will, at his or bet own expease,

with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold

2. That this Permit Is valid for a period of 24 mas. wbich Is considered to be the

for an extension may be made to the Board at a later date.
3. That this Permit should be retained IndefinJtely, or u long u the said Permittee wishes
to maintain the structure or project Involved, to provide evidence to anyone concetned that auth-
orization was originally obtained.
. 4. That the work Involved will be subject to the Inspection and approval of the Board or
its agents, and non-compliaoce with the provisions of the origlnatiog application, may be cause for
revocation of this Permit by resolu~on of the said Board.
5. That there will be no unreasonable interference with navigation u a result of the work
herein au·thorized. .
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That ü future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or ü, In the opinion of the Board of Trustees, the.
work shall cause unreasonable ob.rrucnon to free navigation, the said Permittee will be requited,
npon due notia; to remove or alter this work or project herein stated without expenses to the Town
of Southold.

Dear Mr. Fitzgerald:
The following action was taken by the Board of Town Trustees
during its regular meeting held on June 21, 2000 regarding the
above matter:
WHEREAS, Proper-T Permit Services on behalf of JOSEPH ULRICH
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated June 2, 2000 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on June 21, 2000 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
JOSEPH ULRICH for the existing wood deck and landing, stairs
connecting them and a metal shed.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Sir:
Attached are documents which have been prepared in support of the application for a Grandfather
Pennit for the existing wood deck and landing, stairs connecting them and a existing Trustee-
pennitted dock, and a metal shed on the property of Joseph Ulrich in the Town of South old.
The Trustees inspected this property with me on 9115/99, and the $40 fee was paid on 8116/99.
In the schedule of fees, the fee is shown as $100 for a Grandfuther Pennit, but the listing is quali-
fied with the phrase "Town Waters". Since the project applied for is not in Town waters, is the
fee still $1 OO?
If you need anything else, please let me know.

Dear Sir:
Mr, Ulrich has an existing dock, deck, and connecting steps, Pennit No, 875, for the dock only,
was issued by the Trustees on 4/2/73, and I believe the Trustee office records indicate another
pennit was issued in 1984. The existing dock differs in some respects ITom that described in the
1973 pennit.
I would appreciate it if the Trustees would inspect the property on 8/18/99; I have arranged for
time at the 8/25/99 Work Session to discuss what must be done to legitimize the entire structure
seaward of the house proper,
Several maps are attached for your use in locating the property. I have also enclosed a copy of the
4/2/73 pennit and a check in the amount of $40 for the inspection fee"
