Coastal Erosion Hazard Regulations Technical Interpretation Gedad Rupp - Soundview Ave. Dear Mr. Krupski: As we discussed at our recent meeting, I took it upon myself to secure clarification of the regulation from Mr. Boyd Kahler of the NYS DEC. Based upon my conversation with him the following facts should be considered when reviewing the above application. · The Rupp property is not within a Structural Hazard Area. Currently there are no Structural Hazard Areas on Long Island as pursuant to section 505.2 ( nn ) which defines same es an area where the annual recession rate equals or exceeds 1 foot per year. At present, all structural hazard areas are located in the Great Lakes Region. · The Rupp property is located in a natural protective feature area ( bluff ). Pursuant to Section 505.8 ( c ) ( 6 )" Non major additions to existing structures may be allowed on bluffs pursuant to a coastal erosion management permit." · Pursuant to section 505.2 ( u ), "Major addition means an addition which results in 25% or greater increase in ground coverage of a structure." Therefore the Rupp 8'xl 1' addition is a non major addition. · Pursuant to 505.2 ( 9 ) an existing structure is a "structure in existence on the effective date of an erosion hazard area local law or ordinance" Clearly the Rupp dwelling falls within this definition. Lastly, the Board should note that the granting of a Coastal Erosion Hazard Permit should be reviewed in accordance with 505.6. In this regard, the addition of an 8'xl 1' kitchen area will not have an adverse impact on the natural protective feature as it is landward of an existing bdck patio with the entire bluff face protected by a timber bulkhead.
