Box 1179 Southold, New York 11971-1179 RE: Cleaves Point Condominiums SCTM #1000-38-%42,8 and 38-2-1,45 Dear Mr. Krupski: We seek your understanding and assistance in allowing Cleaves Point Condominiums to file for an expedited amendment to our Marina Permits as we, desperately, need relief from the financial burden that was unintentionally caused by certain terms requiring compliance. Our costs to comply with the two (2) separate dates of removing all floating docks and fingers from our east and west piers amounts to between $7,000 and $11,000 per year to include reinstallation come spring. Inherent in absorbing the lower figure is the risk of unsupervised storage which has resulted in vandalism causing increased repair and maintenance costs. Our understanding of the Trustees' original intent and wisdom was to allow for the harvesting of scallops in our. Marina basin. Unfortunately, there isn't much to harvest, and over the past few years, the scallopers don't even come inside our area. It appears that the bayside of both our docks and the neighbor's dock allow for a more consolidated harvest of whatever is available. With this in mind, we are requesting your assistance in amending our Pernfits to allow for the relocation of all of our floating docks in use on the east and west piers on December 1~ and that we be allowed to lash together all the docks ( like a barge ), and secure them during the winter months with properly engineered lines tied off between the east and west piers parallel to the shore line. Box 2124 Greenport, N~ 11944 Re: Cleaves ioint Condominiums SCTM#38-7-4.2,8 & 38-2-1,45 Dear Mr. Costello: The followin% action was taken by the Board of Town Trustees during a special meeting held on April 27, 1999 regarding the above matter: WHEREAS, Cosl'ello Marine Contracting Corp. on behalf of CLEAVES POINT CONDOMINIUMS applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance cf the Town of Southold, application dated March 3, 1999 and, WHEREAS, said application was referred to the Southold Conservation Advisory Council for their findings and recommendations, and, Town WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 21, at which time all interested p~rsons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed arld are familiar with the premises in question and the surrounding and, areat WHEREAS, the Board has considered all the testimony and documentatior: submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will net affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees grant a Wetland Permit to CLEAVES ~OINT CONDOMINIUMS to install three 4'X 30' floating fingers, three 4'X 25' floating fingers, and an 8'X 66' float to be utilized as a wave curtain. The remaining (5) 6'X 20' floats will have an overall length of 100', all with the stipulation that the floating docks be removed by December 1st of each year and installed on or after April 1st of each year. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may als() have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. But allowing the proposed 8' x 66' float be utilized in place of those fingers so as to remain as a wave curtain and provide safer berthing for the inshore existing boat slips. The overall length of the rem,aining (5) 6' x 20' floats will have an overall length of 100' instead of the requested 120 . ~ Hopefully, agreeing to these modifications will expedite the permit process to its conclusion. Both fixed sections will have 20' section of wave baffles on alternate sides with 10' spacing. The outer "T" will have (2) 4' X 30' fixed finger docks with (2) pilings between. A 4' X 14' hinged ramp will extend off the mid-section of the main fixed pier and rest upon a 6' X 100' series of floats. On the north side of this main float will be (4) 3' X 25' fixed floats with {3) mooring pilings. On the south side of the main float will be (4) 3' X 30' finger floats with (3) mooring pilings. Proposed dock will retain existing 9' 6" fixed inner section; and will extend existing 6' X 90'6" fixed pier to 6' X 235' with an outer "L" of 6' X 32' The overall length of the proposed fixed pier is equal to the length of the present fixed pier, ramp, float and floating wave curtain. A tongue and groove wave curtain will be attached to center of fixed pier. A new 6' X 8' fixed platform will be added to west side of fixed pier and the existing 3' X 14' ramp and (6) 6' X 20' floating docks placed on west side of fixed pier and secured by additional pilings. (11) pilings will be placed various distances west of fixed pier; (5) pilings will be placed 20' east of fixed pier to create slips. Additional pilings will of course be needed for fixed pier and floats. Located Cleaves Points Village, East Marion. Permit will expire two years from the date it is sighed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. %Xvo inspections are required and the Trustees are to be notified upon completion of said project. B. A copy of this permit or approval and supplementary conditions shall be available at the project site whenever authorized work is in progress. Thc permit sign enclosed with the permit or a copy of approval letter shall be protected from the weather and posted in a conspicious location at the work site until completion of authorized work. At least 48 hours prior to commencement of the project, the permittee shall complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work the bottom portion of that form shall also be completed and returned. For projects involving activities to be accomplished over a period or more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 honrs to the commencement of resumption of work each year. If project design modifications take place after permit issuance, the permit- tee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. ~e permittee is advised that substantial modification may require submission of a new application for permit. Ail necessary precautions shall be taken to preclude contamination of any wetlands or wate~ay by suspended solids, sediment~ fuels, solvents~ lubric-- ants, epoxy coatings, paints, concrete, leachate or any other environmental- ly deleterious materials associated with the project work. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law.
