Dear Mr. Lieblich:
The Department of State received your Federal Consisteucy Assessment Form and consistency certjficatiom
supporting information, and additional requested information regarding the above matter on August 22, 2001.
Pursuant to 15 CFR Part 930.58, the following data and information are necessary' to enable the Department of
State to adequately assess the coastal zone effects of this proposed activity:
A copy' of the permit purportedly issued for this project by the Town of Southold Town Trustees does not appear
to be executed and includes throe special conditions for additional agreements regarding re-vegetation,
relocation, and maintenance. Please provide a cop5' of these additional local permit conditions to the Department
of State together with an fully execnted copy of the permit. The Town Trustees permit for this project is valid for
a period of two years and will expire on September 22,2001. Please indicate whether or not this local
authorization to conduct the proposed activities on Town-owned [ands been extended or re-issued.
Your stated purpose for the proposed actMties is the "[r]estoration of beach to original social, economic,
recreational, environmental and protective stares." Please elaborate on this statement, particularly x~ith regard to
"social" and "economic" status.
The upland at the proposed activity is purported to be entirely privately owned. Other than the Public Trust
Doctrine lands and ~aters of the intertidal area, please indicate if any other area of this property' publicly
accessible.
You should assess tile x iabilit5 of removing the exi.sting rock groin and adding beach uourishment material to the
shoreline instead of building new structures in the publicly ox~ned intertidal area. Please provide a thorough
e,.'aluation of alternative measures to the Department of State. particalarJy placing bcach-nourishnlent material
along the prqjcct shoreline, for erosion protection.

The following action was taken by the Board of Town Trustees
during its Regular Meeting held on November 18, 1997, regarding
the above matter:
WHEREAS, FRANK TOMASINI, applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application date~ April
1997 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their finding~ and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on November 18, 1997, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board me~ers have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation sukmaitted concerning this al~plicatio~, and,
WHEREAS, the structure complies with the stana~rd set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,

BE IT FURTHER RESOLVED that this determination should not be

Permit to construct and complete project will expire two ~ears
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.

Dear Ms. Gerbino:
Thank you for sending the Department of State (DOS) copies of the Coastal Assessment Form (CAF) and
supporting information regarding the prbposed groin construction activities in the Town of Southold. We
have reviewed the submitted information as well as information on file at this office. The following
comments and enclosures are provided for your consideration.
In accordance with Executive Law Article 42 and implementing regulations in 19 NYCRR Part 600.3 (c).,
(copy attached), when the Secretary has identified State agency actions which are likely to affect the coastal
area, those State agency actions are required to be undertaken in a manner consistent to the maximum extent
practicable with the coastal management program (or approved Local Waterfront Revitalization Program).
Pursuant to 6 NYCRR Part 617.14(0(10)(i), when an action is not in an approved local waterfront
revitalization program area, an identification of the applicable coastal policies of Executive Law, Article 42
as contained in 19 NvYCRR 600.5, and a discussion of the effects of the proposed action on, and their
consistency with such policies, must be produced. Since permits from the New York State Department of
Environmental Conservation CNYSDEC) may be required for various portions of this project, NYSDEC must
make its own determination regarding the consistency of its action with the policies and purposes of the state's
coastal management program. No State agency involved in an action shall carry out, fund or approve the
action until it has complied with the provisions of Article 42 of the Executive Law.

from flooding and erosion. Such measures shall include:
(i) the setback of buildings and structures;
(ii) the planting of vegetation and the installation of sand fencing and drainage systems;
(iii) the reshaping of bluffs; and
(iv) the flood-proofing of buildings or their elevation above the base flood level.
(2) Mining, excavation or dredging in coastal waters shall not significantly interfere with the natural coastal
processes which supply beach material to land adjacent to such waters and shall be undertaken in a manner
which will not cause an increase in erosion of such land.
(4) Activities or development in the coastal area will be undertaken so as to minimize damage to natural
resources and property from flooding and erosion by protecting natural protective features, including
beaches ....
(5) Activities and development, including the construction or reconstruction of erosion protection structures,
shall be undertaken so that there will be no measurable increase in erosion or flooding at the site of such
activities or development or at other locations.
Our comments are included within the attached copy of correspondence from Fred Anders of our office to
Albert Krupski Jr. of the Town of Southold. In his letter, Mr. Anders discusses a variety of issues pertaining
to construction of groins within this area of Gardiners Bay. The letter also contains alternatives to
construction of the groins which if implemented, may provide protection that results in fewer detrimental
impacts to the existing natural protective features. Please consider these suggestions in your evaluation of
the proposed groin projects with respect to the goals and objectives of the New York State Coastal
Management Program.
