Cutchogue, NY 11935 RE: SHIU CHING CHEN 7433 SOUNDVIEW AVE., SOUTHOLD SCTM#59-6-5.1 Dear Mr. Barratt: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wed., July 23, 2008: WHEREAS, Robert Barratt PE on behalf of SHIU CHING CHEN applied to the Southold Town Trustees for Transfer of Wetland Permit #5051 and an Amendment to Permit #5051 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 23, 2008, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, Wetland Permit #5051 was issued to the previous owner for a 4'X 20' fixed dock with the condition the existing 7' wide dock was reduced in order to comply with the permit and to be completed within six (6) months from the date of the public hearing, from the Board of Trustees dated August 30, 1999, and, WHEREAS, Wetland Permit #5216 was issued to the previous owner for an additional cesspool to be added to property or to rebuild second cesspool near driveway with the stipulation the 4'X 20' fixed dock comply with the permit issued for same, from the Board of Trustees dated September 20, 2000, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure, as applied for, does not comply with the standards set forth in Chapter 275 of the Southold Town Code, and, WHERAS, the Board has determined that the structure, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, NOW THEREFORE BE IT, RESOLVED, that for the foregoing reasons, and based upon the application's failure to meet the standards contained in Chapter 275 of the Town Code, that the Board of Trustees deems the proposed project to be Inconsistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, based on the size of the existing structure, and, BE iT FURTHER, RESOLVED, that the Southold Town Board of Trustees DISAPPROVES the application of SHIU CHING CHEN to replace the deck boards on the existing 8'X 24' fixed dock, as applied for, and, APPROVES the Transfer of Permit #5051 for a 4'X 20' fixed dock with the condition the existing 8'X 24' fixed dock is removed and replaced with a 4'X 20' fixed dock using open-grate decking or untreated lumber, within 60 days from the date of this resolution. Chen and their check in the amount of $100.00 is attached to cover the application fee to transfer and also respectfully apply for some changes to the permit as detailed below: The requested configuration of the dock was conceived and approved in 10/5/00. Since that time: 1. Other methods of construction are emerging that allow more daylight to penetrate below the dock walkways to the water below. 2. Our concern for the mobility impaired and their special needs are better understood. The present house with most of the living space on the first floor, the almost fiat tot and the wider dock are well suited to meet these needs with some minor additions. 3. The marine life around the dock has flourished. People better informed in these matters than the writer have identified evidence of critical fish activity as indicated by the lighter cimles in the pond bottom mud near the existing pilings. Others, in the field, at the recent workshop suggested delicate marine eco-systems might suffer disruption if established pilings are disturbed. Accordingly the applicant suggests that a better solution, addressing all of the above, would be to retain the current dock support structure and replace the current floor boards with ones that permit substantially more light to reach the pond under the dock than the proposed design of 10/5/00 allowed. For instance the currently proposed 6in floor planks 6.75in OC only permit 11.1% of the daylight to reach the pond water under the dock. Their replacement with 1.5in wide planks 3in OC, or 1 .Sin wide 2.25in OC, would permit 50% and 33% of the daylight to reach the pond water below the dock respectively. This approach has the added benefit of possibly being more pleasing to the eye than some of manufactured gratings that raise the specter of an industrial image, some might deem inappropriate, in the Great Pond setting The details of our proposal are shown in the drawing, of which (3) copies are attached, Three (3) copies of the completed application ara attached for your review.
