Dear Mr. Bontje:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 26, 2003 regarding the above matter:
WHEREAS, Michael P. Bontje on behalf of INGER BOYAJIAN applied to the Southold Town
Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold, application dated December 31, 2002, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
W]rlEREAS, a Public ttearing was held by the Town Trustees with respect to said application on
February 26, 2003, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally vie~ved and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of INGER BOYAJIAN to
renovate the house, deck, and bulkhead within the existing footprint, with the condition that
drywells and gutters are installed to contain the roof run-off, no work can be done on the jetty
unless the applicant comes before the Board with an application to amend the permit and include
a plan for a low-profile jetty, the first story finished floor height elevation of the house shall not
increase greater than 24" from the present elevation, and as depicted on the plan prepared by
John C. Ehlers dated May 19, 2003 and the survey prepared by John C. Ehlers last dated June 11,
2003.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of $5.00 per inspection. (See attached schedule.)

I am writing in regard to a request which has been made by Brian Valenti
pertaining to a dangerous situation which exists at the end of Bay Avenue
in East Marion.
Mr. Valenti visited my office yesterday (Tuesday, January 21, 2003) at
which time he inquired as to whether I was aware of a dangerous
condition at the southwest corner of the parking area located at the foot
of Bay Avenue, by the Bay in East Marion.
During our discussion, Mr. Valenti expressed his desire to build a
bulkhead retaining wall across the front of his property. He further stated
that, if a permit for his project was granted by the Board of Trustees, he
would be willing to install a bulkhead retaining wall on the east side of his
property (in a northerly direction) in order to prevent the problem area in
the parking area from sustaining any further erosion.
I personally inspected the area today and can see where an old bulkhead
once stood. Although I have no knowledge of the specific rules and
regulations regarding coastal management restrictions; I can state that if
this project is feasible and subsequently approved, it would solve an
erosion problem which the Town of Southold Highway Department
presently has at the above-described location.

Honorable Trustees:
I am writing to provide you with additional data in regard to tfie subject propeay
located at the south-x,.esterl.,, end of Bay Avenue. I began work on the referenced
property in 1992 ibllowing tile ltl() year nor'easter of that time. The property ,.`. as owned
by Sandra Zatarian and bas reccntly been transfen'ed to Mrs. [nger Boyajian.
In 1992, tile nor'easter had tom oat a bulkhead :`.hich occurred on tile southern
end of the property{at that time l opposite the southern end of the Town boat ramp. This
bulkhead is clearly e'.'ident on a 1972 survey of the property by Van Tay & Sons and had
just been replaced itl 1991. A second `.~ooden wall or bulkhead was apparent at the
southern end of the deck. It was intact at that time. While Mrs. Zatarian eventually won
the right in the New York State court {Index #92-19934) to replace the original southerly
bulkhcad, the replacement of the second northerly bulkhead l at the south end of the deck)
was considered necessaO' to preserve their property and tile Town's property. Mrs.
Zatarian received, in 1993, both To`.xn t#4199) and NYSDEC { 1-4738-0840/001 ~ permits
to implement tile action.
The item of additional note in this case is tfiat the notq. herly bulkhead (which ~'.e
seek to re-permit and replace in this application) ,.,.'as granted a To`.xn of Southold
building permit on June 15. 1971 (#5356ZL This approval date demonstrates its
cxistcncc prior to elmCtlnent of the Trustees Southold's wetland ordinance (Chapter 97)
xxhich occurred on June 29. 1971. As recently as tile mid- 1990's 5our guidance to
applicants contained a "Grandfather Pemfit" provision. This pcmfit recognized the
special slatus granted to structures legally itl existence prior to enactment of yoar
wetlands jurisdiction. \Vhilc thc Trustees apparently no longer grant this specific
app.'oval, the principal remains. This action is not a new acti`.ity. It `.,,'as the subject of
sex oral prior permits and even a court case. Further. this structure clearly pre-dates cx cn
Chapter 97's jurisdiction.
The original bulkhead is llOt being replaced, the NYSDEC permit No. 1-4738-
0840 001 remains in effect and only your approval is necessmT to finally accomplish this
activity. Gix en the fact that the proposed action is necessary to protect both public and
private property, that it has a x alid NYSDEC permit and that it is. in l~ct, a grandfathercd
structure at the proposed location (i.e., the northerly as opposed to the southerly bttlkbcad
is proposed tbr re-establishment), I urge you to approve the application as soon as
possible.

Dear Honorable Trustee:
I am a x~etland consnltant with some 22 years experience.' I began work on the
referenced property in 1992 following the 100 year nor'easter of that time. The property
was owned by Sandra Zatarian and has recently been transferred to Mr. Valenti.
In 1992, the nor'easter had tom ont a bulkhead which occurred on the southern
end of the property opposite the southern end of the Iown boat ramp. This bulkhead is
clearly evident on a 1972 sur-,'ey of the property by Van Tay & Sons and had just been
replaced in 199l. A second wooden wall or bulkhead was apparent at the southern end of
tile deck. It xxas intact at that time. This survey and the photographic evidence of the
original bulkhead was the subject of my affidavit of October 29, 1993. This affidavit was
presented in the case of Zatarian, ct. al. v. Thomas C. Jorling (New ",'ork State
Department of Environmental Conservation, NYSDEC). index # 92-19934. This case
was resolved in the property owner's favor to re-install the bulkbead at the original
location at the southern end of the Town boat ramp.
In 1993, application was made to replace the second bulkhead some 25 f~ect to the
north. 17he second bulkhead would bare reduced Mr. Zatarian's upland property but
would occur on the southern end of tile then, relatively stable deck. The bulkhead (and
gabions set behind it) would protect not only the house but also the adjacent Toxxn road
and boat ramp on tile southern end of Bay Avenue. While Mrs. Zatarian eventually won
the right in the New York State court to replace the original southerly bulkhead, the
replacement of the second northerly bulkhead was considered necessary to preserve their
property and tile Town's property. Mr. Zatarian received, in 1993 both Town
and NYSDEC (1-4738-0840/001) pemfits to implement the action.
Tile propert.,,: (and ~,roject) has lain dornlant since that time. A continued
deterioration of the property has occurred. At this point, the second, northerly bulkhead
has been eroded to a state where the deck, house and Bay Avenue are endangered. The
deterioration has progressed to the point of safety concerns and the total loss of value to
the applicant and property owner. With regard to safety, the deck is obviously unstable.
However, material is also washing out from Bay Avenue and beginning to unden'nine the
northern end of the ramp. In the time between my November and December 2002 visits,
a bole some 2 to 3 feet in diameter and depth has opened in Bay Avenue. It is of utmost
importance to both the applicant and the Town to re-approve the permit of 1993. This
action would stabilize the collapsing roadway, deck and property without significantly
impacting the environment (in fact, 750 sqnare feet more tide lands will exist than that
occurring prior to 1992). Since the original bulkhead is not being replaced, the NYSDEC
permit No. 1-4738-0840/001 remains in effect and only your approval is necessary to
finally accomplish this activity.

Motion carried.
Moved by Stephen Angell, seconded by John' Holzapfel. it was
RESOLVED to recommend to the Southold Town Trustees
DISAPPROVAL of the Wetland Application of STRONG'S MARINA
122-9-6.2 to construct new bulkhead, dredge in front of new
bulkhead, backfill behind new bulkhead and grade parking away from
bulkhead.
The Council recommends disapproval because no need was

This survey depicts the Zatarain property as
from whom Zatarain purchased the property.
3. In the course of reviewing the files of the
local surveyor for another client, I discovered that a survey of
property adjacent to the Zatarain property had been commissioned
environmental consulting firm with offices located at 225 Main
Street, Northport, New York 11768.
2. I was retained by petitioner Richard Zatarain
in September, 1992 to investigate the damage to his property
caused by the lack of bulkheading and to assist in obtaining the
permits and approvals necessary to build a new bulkhead and
prevent further erosion.
This survey also depicts Zatarain's bulkhead existing in 1972 as
contiguous with the end ~the concrete ramp or approximately 35
feet from the south exterior wall of the house.~~ ~ / ~ ~- ~_
5. After reviewing this survey, on ~, 1993,
I personally inspected the Zatar~in property. I found remains of
the original bulkhead in the same position as depicted in the
survey. These remains were located approximately thirty five
(35) feet south of and parallel to the southern exterior wall of
the house (i.e. contiqous with the end of the concrete ramp.)
(See copies of photographs taken by me during this inspection
annexed hereto as Exhibit B).
6. The survey and my'personal inspection of the
property clearly demonstrate that after Zatarain's bulkhead was
destroyed by storm damage in 1982, the bulkhead was repaired and
replaced in the same location as it existed in 1972.
7. I am further convinced that Zatarain never
constructed a second bulkhead but merely repaired and replaced
his existing bulkhead on several occasions.
8. I immediately showed this survey and reported
the results of my inspection to Richard Zatarain and his counsel,
who informed me that this survey was never before presented to
this court or to the previous judicial body in this proceeding.
9. I believe that this survey presents crucial
evidence concerning the existence of the bulkhead in 1972 and
should be considered as evidence by the Court in order to
properly adjudicate these issues.

DISAPPROVAL of the Wetland Application of STRONG'S MARINA
122-9-6.2 to construct new bulkhead, dredge in front of new
bulkhead, backfill behind new bulkhead and grade parking away from
bulkhead.
The Council recommends disapproval because no need was
demonstrated for the bulkhead and, in fact, proposed project would
eliminate a potentially important marshland area which is already
developing. The CAC suggests the road runoff be contained on the
property. This would eliminate the erosion and alleviate the need
for dredging and bulkheading.

Thank you for meeting me yesterday at the subject property.
Per your request, I have included the following items with some
comments:
I am hereby requesting a fee waiver as the bulk
of the damage we witnessed was due to the storm
of December 1992.
A sealed survey of the property is enclosed. The
1.5 foot wide encroachment of Bay Avenue will be
eliminated by the proposal before you.
A Long Environmental Assessment Form is included.
Potential impacts from the project are insignificant
as the structures to be rebuilt are all outside
any wetlands and within the existing, structural
foot print.
With regard to New York State Department of Environmental
Conservation (NYSDEC), the proposed project is outside of their
jurisdiction. That is, my inspections of the property revealed
that the property itself and those parcels occurring to the east
-- that is the roadway, Bay Avenue, and adjacent private parcels
to the east have bulkheads for more than 300 feet. That property
occurring immediately to the west does not have a bulkhead and has
an expanse of approximately 50 feet. Properties occurring west
of that adjacent parcel have bulkheads for considerable distance
(i.e., again more than 300 feet). In short, those properties
occurring substantially to the east and substantially to the west,
are contained by a series of bulkheads and/or sea walls along the
shoreline. Further, the tidal wetland line (i.e., the mean spring
high water (MSHW) line) is linear and parallel to the bulkheads
themselves. Pursuant to Tidal Wetland Use Regulations Tidal 6
NYCRR Part 661, the NYSDEC's jurisdiction ends at the sea wall in
B.Laing Associates

those instances where the sea wall extends more than 100 linear
feet parallel to the water and has no gaps in it exceeding 100
feet in a manner parallel to the water. Therefore, it is my
conclusion that the Zatarain property is NYSDEC nonjurisdictional
above the mean spring high water line for the proposed activity.
With regard to State Environmental Quality Review (SEQR), we
would again request that no such review is necessary and would
cause unneeded delay. Such delay is not a benefit to the Town as
the damage to the deck, deck supports and house may be constructed
as a public hazard. In fact, during a visit in January 1993, Mr.
Zatarain witnessed children playing upon the broken portions of
the deck. Demolition of the deck and support walls alone, how-
ever, would expose the cottage to immediate collapse. Therefore,
toward the end of achieving public safety and allowing the owner
continued use of their property, please grant the applicant an
emergency permit to proceed with the work as shown.

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a projec't
or action may be significant. 'The question of whether an action may be significant is not always easy to answer. Frequent-

significance may have little or no formal knowledge of the environment or may be technically expert in environmental
