The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on September 25, 2002, regarding the above matter.
WHEREAS, Alpha Consulting on behalf of Jori Nowak applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application
dated September 5, 2002
WHEREAS, said application was referred to the Southold Town Consev,'ation Advisory
Council for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
September 25, 2002 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE 1T,
RESOLVED, that the Board of Trustees approved the application of Jori Nowak for a Wetland
Permit to construct a 4'x30' fixed catwalk, and pulley system as per approved plans dated
9/25/02
BE IT FURTHER RESOLVED that this detemfination shonld not be considered a detemfination
lnade for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
If inspections are required, at a fee of $5.00 per inspection (See attached schedule).

This is an addendum to our letter of September 16, 2002,
concerning the construction of a dock adjacent to our
property on Hashamomuck Pond proposed in SCTM#1000-52-5-22.
The sketch submitted with the application did not indicate
the size of the proposed structure. It has come to our
attention, from an item in the Suffolk Times, that the
dimensions of the proposed construction are massive. The
dock would extend 61 feet into the pond. The width of the
Nowak property, which is similar to ours, is only 50 feet.
We believe that the size of the proposed dock is further
evidence of the potential damage this structure poses to
the fragile ecosystem of the pond, especially to shell fish
and to the natural grasses on the shoreline.

Dear Trustees:
As owners of the property adjacent to the proposed
construction in SCTM#1000-52-5-22, we respectfully object
to the building of a dock into Hashamomuck Pond as proposed
by J. Nowak.
As you know, Hashamomuck Pond has a shoreline of natural
grasses and plants and is home to wildlife, birds and
shellfish. On the north and east shore of the Pond, there
are only two structures beyond the bulkhead. Both appear to
be of long-standing. We believe that the natural shoreline
should not be compromised by new construction.
Hashamomuck Pond is a significant resource for Long Island
shellfish. Placing any structure into the pond will make it
more difficult for shell fishermen. In addition, such a
structure might damage the fragile ecosystem of the pond.
In the information provided by Alpha Consulting, there is
no rationale given for building this dock. In the past, the
Nowak's have moored their boat at a buoy. Others on the
pond do the same. Because the pond is small and large boats
cannot enter under the bridges, there appears to be no
compelling reason to begin to build docks along the shore.
Finally, at low tide the pond is very shallow near the
shore. It is clear from the sketch that the dock would have
to be a huge structure and go a long way out into the pond
in order to meet the requirements of a depth of four feet
at low tide. Also, this structure would need to cut across
and possibly damage the wetlands area between the bulkhead
and the shoreline.

Trustees on September 25, 2002. If you wish, we would be
happy to discuss this matter in greater detail at another

Dear Trustees:
AS owners of the property adjacent to the proposed
construction in SCTM#1000-52-5-22, we respectfully object
to the building of a dock into Hashamomuck Pond as proposed
by J- Nowak.
As you know, Hashamomuck Pond has a shoreline of natural
grasses and plants and is home to wildlife, birds and
shellfish. On the north and east shore of the Pond, there
are only two structures beyond the bulkhead. Both appear to
be of long-standing. We believe that the natural shoreline
should not be compromised by new construction.
Hashamomuck Pond is a significant resource for Long Island
shellfish. Placing any structure into the pond will make it
more difficult fo~ shell fishermen~ In addition, such a
structure might damage the fragile ecosyste~ of the pond.
In the information provided by Alpha Consulting, there ks
no rationale given for building this dock. In the past, the
Nowak's have moored their boat at a buoy. Others on the
pond do the same. Because the pond is small and large boats
cannot enter under the bridges, there appears to be no
compelling reason to begin to build docks along the shore.
Finally, at low tide the pond is very shallow near the
shore. It is clear from the sketch that the dock would have
to be a huge atructure and go a long way out into the pond
in order to meet the requirements of a depth of four feet
at low tide. Also, this structure would need to cut across
and possibly damage the wetlands area between the bulkhead
and the shoreline.
