Gentlemen:
The following action as taken by the Board of Town Trustees during a Regular Meeting, held on
March 20, 2002, regarding the above matter.
WHEREAS, Boudnik & Associates. Inc. on behalf of Marion T. Jones applied to the Southold
Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated February 27, 2002
WHEREAS, said application xvas referred to the Southold Toxvn Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
March 20, 2002 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Toxvn Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of Marion T. Jones for a
Wetland Pernfit to remodel cottage by adding a bedroom and bath upstairs no work outside of
existing footprint no excavation.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued xvithin six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified when project is started and on
completion of said project.

At the meeting of the Southold Town Conservation Advisory Council held Monday,
March 18, 2002, the following recommendation was made:
Moved by Drew Dillingham, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit Application of MARION T. JONES to remodel
cottage by adding a bedroom and bath upstairs. No work outside the existing footprint
and no excavation.
Located: 360 Ruch Lane, Southold. SCTM#52-2-21.1
The CAC recommends Approval with the Condition that hay bales are placed down
before construction.

Dear Lauren,
Please find enclosed a letter from BOUDNIK & Associates to the Trustees requesting a
waiver of DEC and Trustee permits for the referenced construction project.
We are working with Mrs. Marion Jones in developing a plan to add a second story on to
f~,ottage located at :~0 Ruch Lane, Arshamomaque Pond, Southold. The work to be
done will not include any enlargement to the cottage's footprint, only a second story.
The existing 4 bedrooms will be remodeled to include only 3. There will be no work
whatsoever regarding moorings, docks, bulkheads, etc.
I was told when I visited the DEC offices in Stony Brook last week, after showing them
the enclosed site survey that since this cettaf~e is located on a si,qnificant bluff, it is out of
the DEC's jurisdiction and will not requite a permit, only a letter stating that the
property is, indeed, out of the DEC's jurisdiction. I have since applied for the letter but
will, in all likelihood, not receive it before the Feb. 28 deadline for the March 20 hearing.
In reading the Board of Trustees policies thoroughly, I see on page 2, section 4 under
WETLAND/TRUSTEE LANDS PERMIT, that "local statute empowers the Trustees to
waive certain application mquirernents including the necessity of obtaining all other
required permits and approvals (prior to submitting a complete application)."
I am requesting that the Trustees waive the requirement for a Wetland/Trustee
Lands Permit for this project.
I would like to make the application for the building permit ASAP and need some
indication as to the next step regarding my enclosed request. I will call you on Tuesday
afternoon, after you have received this, to discuss the matter. Your help will be greatly
appreciated.

Dear sirs,
We are the architects working with Mrs. Marion Jones in developing a plan to add a
second story on to her cottage located at 360 Ruch Lane, Arshamomaque Pond,
Southold.

Environmental Assessment Form and survey/sketch.

WETLAND/TRUSTEE LANDS PERMIT
A Wetland Permit is required for any activities within 100 f~et of any wetland or surfa~
waters in the Town. The Trustee Lands permit applies to all moorings, piles, docks, bulkheads,
and other in-water structures and activities. If you have questions regarding whether the Trustees
have any jurisdiction over your activity, please contact the Trustees. The Trustees or their
representatives will assist you in making this determination.
The application requirements for a Wetland/Trustee Lands Permit are as follows:

Complete application form. Fill out all items contained in the sections identified as
General Data and Wettandffrustee Lands Permit Data, Notice to Adjacent
Property Owner. Also, be sure to complete the attached statement requiring
notarized signature.
2) Complete short Environmental Assessment Form.

Provide a recent (within I year) ~rvey of the property showing all existing and
proposed structural improvements, including soundings done at low tide if you are
proposing a structure out into the water. Yom sorveyor should be aware of the survey
requirements set forth in local statute.

For us to determine that the Del:~ment does not have judsdk::tion.;~you must provide documentation
that your project,"property satisfies one of three conditions (please see I,II, and Ill, below). Please
make sure that your inquiW includes all required documentation. Inadequate submissions or
discrepancies cannot be interpreted in your favor. All inquiries must include:
A completed application form (Joint Application for Permit) stating the reason a determination is needed;
nature of project; address and telephone number of landowner; and the same information for any contact
person (authorization letter required).
Recent clear photographs (dated) showing relevant conditions at the site.
A location map showing the property in relation to local roads an landmarks.

to Auqust 20, 1977, and has remained functional:
Provide two copies of a survey of the site dated before Auqust 20, 1977 which clearly shows the structure (i.e.,paved
road, Dulknead. seawall, retaining ,gall, etc.) and confirms its Jength. Two cop~es of a plan having all proposed
construction must accompany the survey. Photographs must show entire structure. If a survey cannot De provided that
