The Board of Town Trustees took the following action during its regular meeling held on
Wednesday, October 24, 2001 regarding the above matter:
WHEREAS, JOHN W. & MARYANN S. SEWELL applied to the Southold Town Trustees for
a permit under the provisions of the Wetland Ordinance of the Town of Southold, application
dated October 3, 2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the To,,~m Trustees with respect to said application.on
October 24, 2001, at xvhich time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,

RESOLVED, that the Board of Trustees approve the application of JOHN W. & MARYANN
S. SEWELL to construct a 15'X 27'7" deck with 4"X 4" wood, onto the existing single-family
dxvelling, with the condition that all raimvater run-offis contained.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Pemfit to construct and complete project will expire txvo years from the date il is signed. Fees
must be paid, if applicable, and permit issued xvithin six months of the date of this notification.
Two inspections are requi~ed and the Trustees are to be notified upon completion of said project.

Project Description
The proposed project consists of interior renovations and the addition of an unenclosed wooden deck to
the existing house. The nature and extents of the deck are described in the attached drawing labeled
"proposed site plan". It should be noted that the existing house does not conform to current zoning
regulations because of its proxi~nity to Arshamomaque Pond. The south wall of the existing house, built
sometime in the 1960s or 1970s, is located roughly 60' distant in plan from the high witter line. This
distance varies because of the irregularity of the shoreline.
We have applied to the NY State Dept. of Environmental Conservation for a letter of non-jurisdiction
because the work in question takes place landward of a substantial (12'-0" high) bluff, and it is our belief
that we will be granted this waiver of jurisdiction forthwith.
The area of the proposed deck is approximately 520 square feet. The only excavation or new grot~nd
construction required would be the installation of between 8 and 10 4" x 4" posts in the ground. [t is
further planned that the framing and surface of the proposed deck be constructed of untreated spruce and
cedar in order to minimize chemical run-off into the creek.
The proposed deck is consistent with other construction aJong Arshomamque pond, particularly in the
"long creek" section where our house is located. A similar deck, located even closer to the water, can be
found at the adjacent property, tax lot 38. (See attached photographs). It is our contention that the
proposed deck would in fact have a positive environmental impact, as it would limit activity on the bluff
proper, thus assisting its stability and longevity as a natural waterfront. The visual impact of the proposed
deck would be extremely limited due to the fact that the property is extensively screened by existing trees
(see attached photographs)
