The Sitting Room measures 350 square feet and the Mezzanine measures 96 square feet(27% of total area). The Mezzanine,constructed as an interior balcony,creates an intermediate level between the floor and ceiling of the Sitting Room. The Mezzanine and Sitting Room are completely open to, and visible from, each other. The space below the Mezzanine is completely open and part of the Sitting Room. This project,as amended, remains in conformance with the requirements of Section 705.2(b)of NYS Code,which specifically limits this type of structure to two Stories above a Basement or Cellar. It is my professional opinion that the Stairand Mezzanine are permissible, because these elements do not create a space that constitutes an additional Story. 1 have.reviewed these issues with Dan Nichols of the NYS Department of State, Division of Code Enforcement and Administration(518-474-4073)and he is in agreement with my interpretation. Specifically,the space in question is approximately 96 square feet and is located between the ceiling above and a 320 square foot floor area below.There are no partitions on either the intermediate floor space or below the sabject construction. It is our opinion that this intermediate floor space isconsidereda mezzanine. Pursuant to 9 NYCRR 606.3(a)(140),as of December 30,2002,a mezzanine is an intermediate floor between the floor and ceiling of any space that is completely open or provides adequate visibility. Since there are no partitions that would restrict the visibility between the two floor levels,adequate visibility is afforded. Furthermore,per Section 705.1 (g)(5), requires the floor area of the mezzanine be less than one- third of the floor area below.This condition is also met and allows for this space to not be considered a spry. As a point of information,the area labeled`attic'that is accessible from the mezzanine cannot be used for any purpose that is intended for human occupancy.This area also cannot be constructed to meet the light,ventilation,and space requirements for habitable space and still keep the subject floor space classified as a mezzanine. This advisory opinion is rendered based upon the information provided.Administration and enforcement of the code are within the jurisdiction of the local authority.
