DANIELS GOVERNOR SECRETARY OF STATE ----------------------------------------------------------- In the Matter of the Petition of: DECISION Louise Pecoraro and Irene Kassow For a Variance to the New York State PETITION NO. 2004-0653 Uniform Fire Prevention and Building Code ------------------------------------------------------------ Upon the application of Louise Pecoraro and Irene Kassow, filed pursuant to 19 NYCRR 1205 on October 12, 2004, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to an addition to, and alteration of, an existing one-family dwelling, two stories in height, located at 2125 Hyatt Road, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 19 NYCRR Part 1220, The Residential Code of New York State, Section R314.1,which requires that stairways not be less than 36 inches in clear width at all points above the permitted handrail height and below the required headroom height. Handrails shall not project more than 4.5 inches on either side of the stairway and the minimum clear width of the stairway at and below the handrail height, including treads and landings, shall not be less than 31.5 inches where a handrail is installed on one side and 27 inches where handrails are provided on both sides. [The petitioner requests stairways with widths less than required.] FINDINGS OF FACT 1. The building that is the subject of this petition has recently undergone alterations and the construction of a two story addition. In doing so, two new stairways were constructed, one from the first story to the second story, and one from the first story to the basement. 2. The stairway are adjacent to an existing masonry fireplace and chimney which limits their width on that side. When the addition was constructed, a dimensional error was made in the placement of the wall on the other side of the stairways, which left a clear width of only 2 feet 7 inches. 3. There is only one room located on the second story, which is a study of approximately 256 square feet. 4. A small study, bathroom and mechanical equipment room are located within the basement. The petitioner states that widening the stairways would result in a practical and financial hardship. 6. The stairway leading from the first story to the second story was constructed with winder treads at the bottom of the stair which were not in compliance with the Code. The petitioner has proposed that the winder treads be removed and replaced with a landing and a straight run of stairs. 7. The petitioner has proposed that the stairways, as well as the addition and alterations,will meet all other applicable provisions of The Residential Code of New York State. 8. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220,Section R314.1,to permit stairways with widths less than required, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the winder treads at the bottom of the stair leading from the first story to the second story be removed and replaced with a landing and a straight run of stairs. 2. That the stairs, as well as the addition and alterations,will meet all other applicable aspects of The Residential Code of New York State. This DECISION is issued under 19 NYCRR 1205.6. Unless objected to by the petitioner in a writing received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application. BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated August 23, 2001, denying an application for a permit to build an addition to the existing dwelling which will be 28 feet from the rear property line at its closest point. Section 100-244B of the Code requires a minimum 35 ft. rear yard setback. RELIEF REQUESTED:' Applicant requests a variance to locate a proposed addition at the rear of the existing dwelling. At the time of the initial submission, the Building Department's map confirmed a sketched-in addition. While using this scale, the setback for the addition appeared to be 28 feet at its closest point. ADDITIONAL INFORMATION: At the public hearing held on October 18, 2001, the applicant submitted ap prepared by Anthony W. Lewandowski, L.S. confirming the setback for the addition 26 f et. REASONS FOR BOARD ACTION DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board mikes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Properties in this original old development of this area consisted of small one-story dwellings that have nonconforming setbacks, and which were over the years in need of expansion. 2. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue other than an area variance. The dwelling was built prior lo the enactment of zoning in 1957, and its location is angled rather than square to the property lines. Additional difficulty is created because the contour of the property is sloped. To relocate the addition to any;other part of the property would add substantial costs for alterations and possibly additional setback variance. 3. The area variance is not substantial.
