Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no permit is required under the Tidal Wetlands Act. Box 1179 JAN 15 2004 Southold, New York 11971 Re: Ehrenthal Southold town Permit#5592 e— Tr'ie`s Chairman Al Krupski and members of the Board, Enclosed please find a copy of the recent determination made by the Zoning board of appeals concerning the "as built"deck at the Ehrenthal residence. As it turns out the waterside deck that was attached to their home by the previous owner had been built much larger than their building permit had allowed and a CO had not been applied for. The building department therefore separated out the deck and disapproved the "as built". The Zoning Board of Appeals has made a determination that the size of the deck needs to be reduced despite the County's Soil & Water Conservation's report that everything was stable and in good condition despite the proximity to the bluff. (also enclosed) It was our feeling that removal of part of the deck(which was the only part of this residence in decent condition) might cause more problems to the bluff than leaving it "as built". And as the Zoning Board of Appeals was aware that the rest of the project had been recently permitted by your board, I find it surprising that they did not seek your input before reaching their determination. As this is in your jurisdiction and the project has already been permitted by you and you are familiar with the site we ask your input and if necessary, an amendment to the permit to change the "as built" deck to meet the ZBA's requirements. The contractor is currently working on the residence making the other permitted renovations and is waiting for your determination and permission before he touches the deck. If you have any questions or need anything else from us please do not hesitate to contact me. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 27,578 sq. ft. parcel has 135.12 ft. frontage along the north side of Sound View Avenue in Southold, and is improved with a one-story frame house and accessory garage, as shown on the June 10, 1996 survey, revised August 5, 2003 by Peconic Surveyors, P.C. The dwelling is 24+- feet from the top of the bank, 64+- feet from the bulkhead, and 68+- feet to the mean high water line along the Long Island Sound. BASIS OF APPLICATION: Building Department's May 13, 2003 Notice of Disapproval, citing Section 100-239.4, in its denial of a building permit application regarding an existing deck, constructed at less than 100 feet from the top of the bluff. Although the Notice of Disapproval states the deck is 36+- ft. from the top of the bank, when visiting the site, Board Members found the setback of the deck to be at zero. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 20, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants are requesting approval of the as-built location of the northerly open, unroofed deck built at a zero setback from the top of the bluff, which is 47+- feet from the mean high water mark shown on the June 10, 1996 survey, revised August 5, 2003 by Peconic Surveyors, P.C. The side setbacks of the deck are 28+- feet from the westerly side line and 47+- feet from the easterly side line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: I. Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The open, unroofed deck, was built in its current location, is 40'15" wide with variable depths between 12'6" and 24'9", with a zero setback from the Page 2—December 4, 2003 Appl. No. 5427—R. and P. Ehrenthal 51-4-11 at Southold top of the bank, without a building permit or other approval. More than 50% of the deck is located within the Coastal Erosion Hazard Area. An alternative smaller deck would increase the setback to the top of the bank, which setback is required under the code provision to be a minimum of 100 feet. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house is nonconforming with its current setback of 24+- feet from the top of the bank. 3. The grant of the variance requested is substantial. The code requirement is 100 feet from the top of the bank, and the applicant requested a 100% reduction from the code requirement. The alternative allows a smaller deck, instead of the 24'9" deep originally requested and minimizes any detrimental impact adjacent to the bluff area. 4. The difficulty was self-created when the deck addition was built without a building permit and without conforming to the current code requirements. 5. No evidence has been submitted to suggest that a variance will have an adverse impact on the physical or environmental conditions in the neighborhood. A report prepared by the Suffolk County Soil and Water Conservation District on November 7, 2003 indicates that the bluff is in excellent condition and that the bulkhead at the bluff toe is in sound condition without evidence of erosion. The report recommends that the landowner monitor the growth of the Phragmites australis and to adopt a control method if the phragmites begins to encroach upon the healthy stand of beach grass on the property. 6. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an open, unroofed deck, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to DENY the variance as applied for, and to GRANT alternative relief for an open, unroofed deck, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The deck shall be open and unroofed, and not be enclosed. 2.
