Dear Mr. Hurtado:
The Southold Town Board of Trustees reviewed the survey prepared by Michael James
Hillebrand last dated January 21, 2004 and determined the proposed demolition of the
existing dwelling and construction of a new single-family dwelling to be out of the
Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the
Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however. that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above. without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the Udal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence. barrier, or hay bale berm 100' from the wetlands, as depicted on the survey. In
addition, drywells and gutters must be installed in order to contain the roof run-off.
However. any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.

A final inspection is required. Please notify the office when the project is complete.
This determination is not a determination from any other agency.

Dear Mr. Hurtado:
The Board of Town Tmstees took the following action during its regular meeting held on
Wednesday, Febmary 26,2003 regarding the above matter:
Vv'HEREAS. J & C HOLDINGS LP applied to the Southold Town Tmstees for a permit under
the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated January 23, 2003, and.
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Tmstees with respect to said application on
Febmary 26, 2003, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has cansidered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the stmcture complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has deternlined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of J & C HOLDINGS LP to
add a 39.8' X 33' addition to the existing 20.4'X 26.4' residence, with the condition that
drywells and gutters are installed to contain the roof run-off, and as depicted on the approved
plan dated July 27,2002 and last revised March 3, 2003.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$5.00 per inspection. (See attached schedule.)
