Dear Mr. Costello:
The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on September 19, 2001, regarding the above matter.
WHEREAS, Costello Marine Contracting Corp.. on behalf of Ricardo Rengifo applied to the
Southold Town Trustees for a permit under the provisions of the Wetland Ordinance ofithe Town
of Southold, application dated August 3, 2001
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
September 19, 2001 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar xvith the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
Safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of
Costello Marine Contracting Corp. on behalf of RICARDO RENGIFO for a Wetland Permit to
reconstruct existing 4'x46' dock, in kind/in place, and extend it another 10' for a total of 56' then
continuing xvith a new 32"x16' ramp leading to a new 6'x20' float secured with two anchors no
pilings and the jetty will be removed underueath dock. Float and ramp are seasonal removed
October 1, through April lst.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct project will expire two years from the date it is signed. Fees must be paid, if
applicable, and permit issued within six months of the date of this notification.

Dear Ms. Standish:
In reply to your correspondence dated September 25,200l and the above captioned
property, I do not have specific information relative to when the subject retaining wall
was built nor do I ~know who actually built it.
During the month of December 2000 I visited the property in Greenport in which I have
an interest and saw the retaining wall for the first time. In my opinion the wall must have
been erected between July 2000 and December 2000 as I generally make a summer and a
winter visit to the property. I enclose a copy of letter that I sent to Dr. Rengitb dated
January 8, 200l inquiring about the subject retaining wall. Although Dr. Rengifo phoned
me subsequent to receiving my correspondence, he never provided me with the
information that I requested.
As I am sure you are aware, the survey that is on file with the Town of Southold is dated
1972 and does not show the retaining wall. The sketch, however, that I received ,t~om
Costello Contracting dated July 200l and relative to the application to reconstruet a dock
and a new jetty does in fact show the retaining wall clearly on our property (SCTM #45-
5-7.1 ), a copy of which is enclosed for your reference.
Please refer to the photos that I included with my August 8, 2001 correspondence to the
Board of Trustees relative to the above mentioned permit application submitted by
Ricardo Rengifo. These photographs were taken in September of 1999 and clearly
indicate no existence of a retaining wall at that time.
I would appreciate your advising me as to what the South Town Board of Trustee's
intentions are with regard to this matter.

Dear Sirs:
At the last Trustees' meeting, the Board made a decision to revisit the
applicant's property in order to determine whether to allow our proposal to extend
the fixed portion of the dock by 10 feet that has been required by the NYSDEC,
and to allow a seasonal 32" x16' ramp onto a 6'x20' float with the related piling.
I plead with the board to inspect the proposed project site at Iow tide
because it will become more evident that our proposed application is a
reasonable request. It is also our client's intention is to remove the ramp and
float on a seasonal basis. The additional tie-up piling are requested in order to
provide safer berthing for our client's boat into the prevailing Southwest summer
breeze and the occasional easterly weather that is encountered. The removal of
the float and ramp will allow any baymen, although a slightly inconvenience, to
clam or scallop between the proposed piling. Please note that the other docks in
the area reach adequate depths of water with a slightly shorter dock. The
property owner, Mr. Rengifo, is not enthused about having his boat on bottom at
most Iow tides. We don't feel the proposed dock extension poses any
environmental degradation or any navigational hazard.

Ladies and Gentlemen:
[n connection with the above captioned property, we are the owners of an adjacent
lot that has been in our fhmily for more than 50 years. On May 2, 200l I received a letter
from the Department of the Army, Corps of Engineers dated April 5, 2001 notifying us of
the proposed reconstruction of an existing jetty. I have questions as to weather the jetty
ever existed, Certainly the remnants of which would be evident at low tide if in fact it
has been 'existing'.
In addition, I received a certified notice from Costello Marine Contractors having
been mailed on July 25, 2001. Said notice advised me ora proposed application before
the Southold Tovea Board of Trustees with a hearing date 'unknown' accompanied by a
new sketch revised four times since the survey submitted to the Corps of Engineers. As I
am sure you are aware, there are several changes on the July 21, 2001 edition that were
not included on the sketch dated February 24, 2001 that was sent to the Corps of
Engineers back in April
I spoke with Ms. Lauren Standish, secretary to the Board of Trustees yesterday
who advised me of the hearing date of August 29, 2001. At this point 1 am not sure if I
will be available to attend the hearing, however I did want to bring several things to your
attention prior to your physical inspection of the subject property.
We have had an ongoing situation with the Rengifo's dating back the last three or
tbur years. I generally make one or two visits to the property annually and the tkst
problem that existed was a rickety, makeshift wooden barricade that was put across Shore
Road, just east of his eastern property line. Subsequent to that, he had built two brick
piers, one on the north side of Shore Road and one on the south side of Shore Road
blocking access to our property. They were approximately 18" square by 4 feet high and
topped with a decorative pre-cast concrete ball. Since they were installed, they have been
broken in half and the tops are sitting next to the bases still in the road shoulder area. At
present, the wooden barricade appears to be one that might be a replacement to the
original one and is still there.
In addition, the Rengifo's have encroached our property with different stru~ures
and/or items such as an outdoor shower, lampposts, split rail fence, old lobster pot lines
and a makeshift wooden patio. These encroaciunents were the subject of a written
complaint I filed with Southold Tovm on September 22, 1999.

In December of 2000 I visited the property and was surprised to see a nexv
retaining wall installed along the Rengifo's western boundary line. It appeared then that
it was on our property and I requested of Dr. Rengifo a copy of his survey, to no avail.
The sketch accompanying the application fi.om Costello clearly shows that this
new retaining wall has been installed on our property without our permission and must be
removed.
For your ready reference and in support of the above I enclose photocopies of the

Dear Dr. & Mrs. Rengifo:
This office represents the owners of the large tract O~ land
adJoi~ing your property, the access to which is on the private road
in front of your house.
You have erected piers and other obstacles which would in effect
block entrance to my client's property. These encroachments are on
the priyate road and as you have been advised by the Town, are
improper as they block entrance to my clients property and should
be removed. They constitute the brick piers, the barricade, and the
fence. In addition, the light stanchions, the patio, the lobster
pot ropes, and the shower drain are on my clients property and
should alsobe removed.
I have been advised by Mr. Stackler, one of the owners, chat he
spoke to Mrs. Rengifo and informed her of the aforementioned
encroachments and requested that they be removed. This was on
September 9, 1999, and you have failed to take any acCion as
required by my clients and the Town.
Please be a~vise~ that if the encroachments are not removed by
January 15, 2000, my clients will remove them and charge you for
all expenses thereby incurred. I strongly suggest that you have
these encroachments immediately removed to avoid any further legal
actiom.

family's position. I have attached a copy of the letter for your
convenience. As you can see, the Rengifo family will not tolerate
unfounded ect$ of int~=~d~tion by your client.
With respect to ~he items mentioned in Four letter, it is the
position of t~e Rengifo family that they have not trespassed onto your
clients property, ~or here they denied your c~ient access to his
px~pe~y. They are well within ~heir rights to decorate and deeig~ their
prDpe~tyas they see fit. Any attempts to r~ove or destroy those ~bjects
enumerated in your letter will be considered acts of trespass.
Accordingly our office will seek the ~ropriate relief in a COurt of
Law aS ~ell as attorney fees and co~t$.
In addition, our clients have instructed our office to pursue a
claim of nuisance for your clients failure to maintain his property.
Over ~he~ssed few years, your clients property has eroded to ~ point
that i~ has substa~tially ~ffected our clients rights ~o enjoy their own
property.
Finally, representatives from Greenport Shore Drive Association
which is responsible for the private road, have informed our office that
Mr. S~ackler has failed to pay his dues to the associatin for over 30
years. It is our understanding that the association intends to recover
those monies for which it is entitled.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 29, 2001 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of RICARDO RENGIFO applied to
the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated August 3, 2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Heating was held by the Town Trustees with respect to said applicalion on
August 29, 2001, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of RICARDO RENGIFO to
install 142' of new bulkhead in front of existing with C-Loc vinyl sheathing xvith the condition
that all the pipes are completely removed from the bulkhead.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

RE: Coastal Policies # 2, 21, 22 and 44 as they relate to the reconstruction of

Coastal Policy #2: Facilitate the siting of water-dependent uses and
facilities on or adjacent to coastal waters.
Our proposed project is water-dependent as the term is defined in the
NYSDOS's Coastal Policy explanation. Our project will enhance the ability of the
upland property owner to service his small outboard boat, as well fish and
swimming at that location.
Coastal Policy #21: Water~dependent and water-enhanced recreation will
be encouraged and facilitated, and will be given priority over non-water-
related used along the coast.
As stated above, our proposal is water-dependent. Most of the proposed
work is reconstructing the existing dock and reinforcing an existing bulkhead.
Our proposal is consistent with the surrounding area and will allow our client to
adequately service a small outboard motor boat.
Coastal Policy #22: Development, when located adjacent to the shore, will
provide for water-related recreation, whenever such use is compatible with
reasonably anticipated demand for such activities, and is compatible with
the primary purpose of the development.
There is no major development in the project area, nor is any anticipated
in the future. There is an existing dock and bulkhead on the project site. Our
proposal is compatible and consistent with the surrounding area.
Coastal Policy ff.44: Preserve and protect tidal and freshwater wetlands and
preserve the benefits derived form these areas.
Our project is minor in nature and will no have any negative effects on the
environment.
