Dear Mr. Costello:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., April 18, 2012:
WHEREAS, Costello Madne Contracting Corp. on behalf of ROBERT & LAUREN
EICHER applied to the Southold Town Trustees for a Transfer of Wetland Permit #5467
from Monique Morris to Robed and Lauren Eicher and an Amendment to Wetland
Permit #5467, under the provisions of Chapter 275 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold applications dated January 25, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the applications to be Consistent
with the Local Waterfront Revitalization Program, and,
BE IT FURTHER
RESOLVED, that the Southold Town Board of Trustees APPROVES the Transfer of
Wetland Permit #5467 from Monique Morris to Robert & Lauren Eicher, as issued on
December 21, 2001, and,
RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to
Wetland Permit #5467 to install five (5) new bulkhead face pilings adjacent to the
existing face pilings, and as depicted on the project plan prepared by Costello Marine
Contracting Corp. dated January 3, 2012 and stamped approved on April 18, 2012.
This is not a determination from any other agency.

2001 and an Amendment to Wetland Permit #5467 to install five (5) new bulkhead face pilings adjacent

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP.
In the event that the action is approved to further Policy 5: Protect and Improve Water Quality in the
Town of Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold
Ecosystem it is recommended that a vegetated buffer is required landward from the bulkhead.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

I am requesting a permit transfer for the above referenced permit. The new owners of this
property are Robert & Lauren Eicher. Their mailing address is 11 Hillcrest Drive, Pelham
Manor, NY 10803.
I am also requesting an amendment to the above-referenced permit to allow the installation of
five new bulkhead face piling adjacent to the existing face piling. The overall condition of this
bulkhead is good but unfortunately some support piling have fractured. We are confident these
additional piling will add the needed support without the need to do any extensive work to the
bulkhead.
Enclosed is a copy of our project plans, a copy of permit #5467 and check #8553 in the amount
of $100.00 representing the fee associated with both the permit transfer and amendment.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, December 19, 2001 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of MONIQUE MORRIS applied to
the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated November 29, 2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
December 19, 2001, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of MONIQUE MORRIS to
construct 100' of new bulkhead (with C-Loc vinyl sheathing) immediately in fi:ont of existing
bulk_head, with the condition that a 10' non-turf buffer is maintained behind the bulkhead and the
piles are to be removed and the C-Loc constructed right against the existing whalers, and
drywells installed to contain the roof rrm-off.

The practice of replacing structures within 18" has a negative impact to the wetland
resource and would infringe upon and take away from the public domain. Replacing
bulkheads within 18" has an accumulative effect on the loss of wetland resources
