Condominium, as issued on October 26, 2001.
Any other activity within 100' of the wetland boundary requires a permit from this office.

TERMS and CONDITIONS
The Permittee Breezy Sound .c/o Neil B. Esposito
raiding at P.O. Box 815, Quogue N. y, as
part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing: r1
1. That the said Board of Trustees and the Town of Southold am released from any and
all damage, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with raped thereto, to the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 24 mos. which is considered to be the
estimated time required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the strumae or project involved, to provide evidence to anyone concerned that anth-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cam for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
G. That there shall be no interference with the right of the public to pas and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trnttees, the.
work shall cause unreasonable obstruction to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold
S. That the said Board will be notified by the Permittee of the completion of the work auth-
orized.
9. That the Permittee will obtain all other permits and consents that may be required sup•
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Ms. Dloore:
As per our conversation regarding Breezy Sound Corp., enclosed is a copy of the permit
issued by the Trustees regarding the stairs on the bluff. The inspection done on October
1, 2004 by the code enforcer Ed Forrester found erosion on the area which was to be
revegetated after construction. It looks like beach grass was planted but more needs to be
planted to prevent and stop the erosion which is occurring.
Please notify the owner that this planting should be done before the season is over. Please
call our office for a final inspection after the planting is complete.

Dear Ms. Moore:
The Southold Town Board of Trustees reviewed the survey prepared by John W.
Naylor, Jr. dated September 9, 2004 and determined the plans for wastewater
treatment to be just out of the100' Wetland jurisdiction under Chapter 97 of the Town
Wetland Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 24, 2001 regarding the above matter:
WHEREAS, Land Use Ecological Services, Inc. on behalf of BREEZY SOUND applied to the
Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated September 17, 2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
October 24, 2001, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

RESOLVED, that the Board of Trustees approve the application of BREEZY SOUND to
construct a 4'X 72' fixed timber walk and access stairway. The access installation is proposed to
coincide with destroyed access location. The timber walk is proposed to be supported by(36)
4"x 4"CCA timber posts with a depth of penetration of 6'+. A proposed 160 +/- sf of existing
eroded bluff is to be augmented with 20+/- cy. of 500-1000 lbs. stone placed on filter fabric
against existing eroded scarp face. A proposed 200 +/-sf. to be backfilled landward of proposed
stone with 15+/- cy. of clean fill trucked in from an upland source, and then planted with Cape
American Beach Grass on 18"centers. A 3' wide+/- 3' deep+/- X 30' long +/- trench with
gravel to catch and control upland runoff. 10+/- cy. of gravel (1/2"+1- to 1" +/- in dia.) to be
utilized for the drainage troneh. The fill from the proposed drainage trench will be utilized for a
2' wide +/- X 1.5' high +/- X 90' long +/- berm to aid in channeling and controlling the upland
run-off, as depicted on plan dated 8/22/01 and last revised 10/25/01.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.
