WHEREAS, Soundview Restaurant, Inc. applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated September 4, 2003 WHEREAS, said application was referred to the Southold Tox~m Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with~ respect to said application on September 24, 2003 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. WHEREAS, the Board has determined that the project as proposed will not affect the health, Safety and general welfare of the people of the town. NOW, THEREFORE BE IT, RESOLVED, that the Board of Trustees approved a Wetland Permit to repair the existing east xvall - no other alterations or expansion.. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for an), other Department or Agency, xvhich may also have an'application pending for the same or similar project. Fee must be paid, if applicable and pernfit issued xvithin six months: of the date of this notification. If inspections are required, at a fee of $5.00 per inspection (See attached schedule). At this time we request an emergency authorization to proceed with this work as the existing building windows have failed. These windows admit air to the building and are ha da~ger of collapse. We understand that there will be a formal hearing later this month but need to start this work immediately. We have contacted the New York State Department of Environmental Conservation and spoke to analyst Mark Carara and he noted that due to the nature of the project (window replacement) that we will not be required to obtain a building permit or letter of non-jurisdiction fi.om his office. As such we ask for permission to move directly to the buildMg department with this application at this time. We have spoken with Mr. Verity and he is aware of the incoming application and will progress this pei:iifit immediately.
