Box 1179 ~)uthold, New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL At the meeting of the Southold Town Conservation Advisory Council held Monday, October 15, 2001, the following recommendation was made: Moved by Scott Hilary, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of MILTON FORMAN to clear property within 100' of the bluff and maintain a 35' natural buffer. Located: 58105 Sound Ave., Greenport. SCTM¢¢44-2-9 The CAC recommends Disapproval of the application as submitted and recommends a 50' non-disturbance buffer, in addition, the project was not staked. However, the clearing and grading of the property are jurisdictional, and an other activity within 100' .of the Wetland line would require a permit from this office. Ehlers dated August 30, 2000, is beyond the jurisdiction of Article 25 (Tidal Wetlands). Therefore, in accordance with the current Tidal Wetlands Land Use~ Regulations (6 NYCRR Part 661 ), no permit is required under the Tidal Wetlands Act.
