CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Monday,
October 15, 2001, the following recommendation was made:
Moved by Scott Hilary, seconded by Bret Hedges, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Wetland Permit Application of MILTON FORMAN to clear property within 100' of the
bluff and maintain a 35' natural buffer.
Located: 58105 Sound Ave., Greenport. SCTM¢¢44-2-9
The CAC recommends Disapproval of the application as submitted and recommends a
50' non-disturbance buffer, in addition, the project was not staked.
Vote of Council: Ayes: All

Dear Mrs. Mesiano:
The $outhold Town Board of Trustees reviewed the survey dated
August 30, 2000 and determined the construction of a
single-family dwelling to be out of the Wetland jurisdiction
under Chapter 97 of the Town Wetland Code.
However, the clearing and grading of the property are
jurisdictional, and an other activity within 100' .of the Wetland
line would require a permit from this office.
This determination is not a determination from any other agency.
If you have any further questions, please do not hesitate to
call.

Based on the information you have submitted, the New York State Depad'ment of
Environmental Conservation has determined that:
The portion of this property landward of the twelve (12) foot elevation contour, as shown on the
survey prepared by John C. Ehlers dated August 30, 2000, is beyond the jurisdiction of Article
25 (Tidal Wetlands). Therefore, in accordance with the current Tidal Wetlands Land Use~
Regulations (6 NYCRR Part 661 ), no permit is required under the Tidal Wetlands Act. Please
be advised, however, the! no copstruction, sedimentation, or disturbance of any kind may take

It is your responsibility to ensure that ail necessary precautions alre taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or ,vegetation within tidal
wetlands jurisdiction which may result from your project. Such precautions may include
maintaining an adequate work area between the tidal wetland judisdictional boundary and your
project (i.e., a 15 to 20 feet wide construction area) or erecting a temporary fence, barrier, or
hay Dale berm
Please be further advised that this letter does not relieve you of the responsibility of obtaining
any necessary permits or approvals from other agencies.
