The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, Septelnber 25, 2002.
RESOLVED. that the Southold Town Board of Trustees Approve an Amendment to Permit
#5583 to fill cleared area with a quantity of clean fill sufficient to bring the grade level with the
adjoining lots and the road quantity fill to be brought on site is estimated to be < 500 cubic yards.

Artie Foster, a professional excavator with years of
experience observed the proposed work, knew what was
intended, and did not dispute the estimated fill to be
brought onto the property within the Trustee's

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, August 21,2002:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit
#5583 to fill the cleared area of lot with approx. 60 cy. of clean fill, re-grade the site to level with
adjoining lot to the west (approx. 8"-12" grade change), level piles of stockpiled topsoil, create
earthen berm <3' high along south lot line, and deposit <5 cy. rip-rap at NE comer of bank as a
temporary measure to eliminate further degradation of the bluff resulting from the design of the
bulkhead located on the easterly adjoining property.
This is not a determination from any other agency.

At the meeting of the Southold Town ConserVation Advisory Council held Tuesday,
August 20, 2002, the following recommendation was made:
Moved by Drew Dillingham, seconded by Melvyn Morris, it was
RESOLVED to recommend to the South old Town Board ofTrustees DISAPPROVAL of
the Amendment Request of WILLIAM A. LOIS to Amend Permit #5583 to fill the cleared
area of lot with approx. 60 cy. of clean fill, re-grade the site to level with adjoining lot to
west (approx. 8"-12" grade change), level piles of stockpiled topsoil, create earthen
berm <3' high along south lot line, and deposit <5 cy. rip-rap at NE corner of bank as a
temporary measure to eliminate further degradation of the bluff resulting from the design
of the bulkhead located on the easterly adjoining property.

The CAC recommends Disapproval of the application and recommends remediation
and replacement of the 25' eastern buffer and remediation of anything that wasn't done
in accordance with the original permit.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 26, 2002 regarding the above matter:
WHEREAS, Catherine Mesiano on behalf of WILLIAM A. LOIS applied to the Southold
Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated May 30, 2002, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
June 26, 2002, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of WILLIAM A. LOIS to erect
. a 10'X 10' shed, install +/-70' of fencing on the east lot line, a 25' clearing limit on the east side
of the property and a 35' non-disturbance buffer, all as depicted on the survey dated August 30, .
2000 and last revised July 10, 2002.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees

1 am writing to you for two reasons. For one, 1 am your new neighbor and want to intro
duce myself I have been searching for a place in your town for years and finally have
found and closed on the above property and adjacent home.
The second reason for this letter is to acquire permission to clean the above listed
Property. The property is full of scrub brush, weeds and ticks, I know I found one.
At this point in time I would like to clean up this lot, and plant some trees along the
Eastern perimeter, There is presently no trees other than a few saplings (less than 4 inch
Girth). I will send you a survey map and a proposed plan eventually 1 would like to build
a seawall/retaining wall to match with the existing neighbors, concrete sea wall, but am
not asking for that now. Since I want to expedite this request in order to be able to plant
the trees now and to reduce the tick population, prior to the summer months when I may
Loose a significant part of my landscaping.

Based on the information you have submitted, the New York State Department of
Environmental Conservation has determined that:
The portion of this property landward of the twelve (12) foot elevation contour, as shown on the
survey prepared by John C. Ehlers dated August 30, 2000, is beyond the jurisdiction of Article
25 (Tidal Wetlands). Therefore, in accordance with the current Tidal Wetlands Land Use,
Regulations (6 NYCRR Part 661), no permit is required under the Tidai Wetlands Act. Please
be advised. however, that no construction, sedimentation. or disturbance of anv kind mav take
place seaward of the tidal wetlands jurisdictional boundarv. as indicated above. without a

sedimentation or other alteration or disturbance to the ground surface or vegetation within tidal
wetlands Jurisdiction which may result from your project. Such precautions may include

project (i.e., a 15 to 20 feet wide construction area) or erecting a temporary fence, barrier, or

'No siqnificant negative impact to wetlands or tidal water will
result from the proposed activity. A 35' non-disturbance buffer
will remain landward of the top of bank, wi th indigenous low growing
shrubs planted as a windbreak and as protection against further
erosion of the bluff. Large ornamented trees will be planted along
the west and south lot lines. Minor grading will be done to
stabilize the interior of the lawn and gardens will be planted. A
10' x 10' shed will be placed at the east lot line, landward of the
Coastal Erosion Hazard Line.
