Street& Location: Mill Road and Miami Avenue, Peconic County Parcel Ref. 1000-67-6-11 and 67-6-10 as the first lot; 67-6-13.1 (12 and 13 as the remaining lot). Date of Public Hearing: October 21, 2004 PROPERTY FACTS: The property which is the subject of this request to unmerge is SCTM 1000-67-6-11 (Lot 23.2), unimproved land on McCann Lane in Greenport with road frontage of about 55 feet and depth of 160 feet. This land comprises the southerly half of original Lot 14 in the Eastern Shores subdivision, which was filed in 1964. (The adjoining land, SCTM 1000-33-3- 40.1, abuts this land on the northerly property line.) BASIS OF REQUEST: Building Department's Notice of Disapproval dated August 12, 2004, amended August 23, 2004, stating that the subject property, 67-6-13.1, has merged with the adjacent property(67-6-11 and 10), pursuant to Section 100-25, by reason of common ownership with the first lot at any time after July 1, 1983. An adjacent lot is one which abuts with the parcel for a common course of fifty (50) feet or more in distance. Nonconforming lots shall merge until the total lot size conforms to the bulk schedule requirements. The property is located in the R-40 Low-Density Residential Zone District. RELIEF REQUESTED: Applicants request, under Section 100-26, a waiver of the merger of the land area consisting of 16,198.61 sq. ft., shown as 13.1 on the Suffolk County Tax Maps, Section 67, Block 6. The remaining merged land area is noted as .46+- of an acre, identified as County Parcel Ref. 10 and 11. ADDITIONAL INFORMATION: The applicants have obtained sanitary system and private well approvals for a single-family dwelling on 8/2/04 from the Suffolk County Department of Health Services under HS Ref. No. R-10-04-0019 for the 16,198.61 sq. ft. portion of the property. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Lot 13.1 is vacant, unimproved property and comprises lands referred to as 12 and 13 shown on prior County Tax Maps, consisting of a total area of 16,198 square feet and having direct frontage along Inlet Road to the east and Miami Avenue, an unimproved road, to the south. This property is also shown as Lot 6 on the 1926 Map of Property of Blanche T. Dickinson filed in the Office of the County Clerk. CTM Parcel 13.1, owned by O'Malley, is equal to, or greater than, the size of the typical lot originally laid out in that subdivision. 2. The remainder is owned by Edward and Eileen Maguire, since acquiring the property in 1955. This land area consists of combined CTM Lot Ref. 10 and 11, with an area of.46+-of N r' Page 2—November 4,206 - Appl. No.5596—J.and M.O'Malley CTM 67-6-13.1 an acre. This remaining area is improved with a cottage built many years ago, and this area is equal to, or greater than the size of typical lots immediately adjacent, along Mill Road and Miami Avenue. r- 3. 3. Waiver of merger will allow for construction of one single-family dwelling on Lot 1(3i which will not result in a significant increase in the density of the neighborhood. There will be no" need for significant change in the contours or slopes of Lot, icor for substantial filling affecting nearby environmental or flood areas. 4. Testimony was offered that the owners believed the lots were not joined. Waiver of merger will avoid economic hardship for applicant, who has owned, and paid taxes on, Lot 13.1 for 48 years in the belief that it was and is a buildable lot. 5. Waiver of merger will allow for construction of one single-family dwelling on the original lot line dividing this property from the remainder of the property, which will not result in a significant increase in the density of the neighborhood. There will be no need for significant change in the contours or slopes of Lot 13.1, nor a need for substantial filling. RESOLUTION/ACTION: On motion by Member Orlando, seconded by Member Dinizio, it was RESOLVED, to GRANT a Waiver to unmerge CTM 13.1 from the remainder of applicant's property. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. He told us awhile back that he had to write down the reason for asking that the lots 10, 11, 12,and 13 be separated back into two properties. Discussing our reasons among family members got us all reminiscing about the role that the Miami Avenue property has played in our family. The history of those lots is intermeshed into our family's history and I thought it was a story worth sharing with you. Back in the mid 1930's, my mother's parents died within about eighteen months of each other.Her parents had met literally on the boat from Ireland, mai ried shortly after their arrival and bought a brownstone in downtown Brooklyn. My mother was thirteen years old when her mother died. She had seven sisters and brothers. Her youngest sister was three at the time.There were few relatives here in the states and the ones here had their own families and lived on the other side of Brooklyn. Since her oldest sibling,my Uncle Jack,had just turned 18 and was therefore "legal"the kids stayed together with the older siblings basically raising the younger ones. Some twenty years later when my mother's youngest sister was grown and planning to marry,the family brownstone was sold.My mother received a small inheritance from the sale. She recalls that she knew exactly what she wanted to do with the money...buy property on the North Fork of Long Island. (n t ,,;e A ' My father grreup in 11�astic Beach. He tells stories of driving his grandfather to train every morning when he was only 13 years old. He says that the town cops knew he- , was driving but it was the depression,there wasn't any other way for his grandfather to get to the train; and so they just let him. He also remembers sitting on the roof of a friend's house just after the Hurricane of 1938 and watching houses float out to sea. Anyway,my mother got to know Eastern Long Island from my father. She liked the North Fork the best and that was it; she would buy land,build a house and we would all move out there. She found the Miami Avenue land through an ad in the Brooklyn Tablet newspaper.Her family lawyer took the Long Island Railroad out to see if the land was • any good, gave the OK and she bought it.That was fifty years ago this April. Twice in those first couple of years,my parents had the land cleared to build only to have my father's company go on strike and building had to be deferred. There were five kids to feed and going on strike meant that the savings got depleted and there was no money to build. The first couple of summers,we rented locally for a week...Pequash Lane in Cutchogue and Bayview Avenue in Mattituck. My parents would take us to the Miami Avenue property and we would picnic on the property and then go swimming down in the sound. I must say we kids got use to the soft sand and warm water on the bay side where we rented and were not all thatpleased with the ice cold water and heel slitting rocks on the sound side.Nevertheless it became a family ritual: picnic on the Miami Avenue property, dream about building a house, swim in the sound and then back to the rental.My parents would discuss with us where the house would go,the drive way, the garage. In the meantime, in the early 1960's,the white cottage on the adjacent property facing Mill Lane came up for sale. My father's mother, Grace Maguire, sold her house in Oct 17 04 10: 27p O 'Ma11ey 9082761153 p. 5 t Mastic and bought the white cottage with the intention of being able to live near us after she retired. Within a few years,though,my grandmother died.My father inherited the white cottage. My mother's plan to build a permanent home on Miami Avenue never materialized due mainly to the fact that my father's company would never give him a transfer to the North Fork of Long Island and realistically my father could not commute to Brooklyn year round. So my family had to be satisfied with spending only summers in the Peconic.My four siblings and I spent every summer from the day school closed in Brooklyn to the day before school started in the white cottage. My father came out on weekends. My mother spent the week with us, without a car,without an indoor shower,without washing machine or dryer;five kids in a two bedroom cottage. I remember walking the mile into town with the week's laundry on a red wagon.That was how a good part of every Monday was spent. Occasionally, my sisters or brother and I would hide the wagon in the roadside bushes and hitch into town with the laundry. Every Friday, my dad would come out with Ebiuger's cakes and we would all pile in the car and go to the Skyway Drive-In in Greenport, Sophie's Pizza in Southold or maybe just check out things in Sears or Edward's Sporting Goods in Riverhead. . Even though the two Mill Lane lots on which the cottage was located were adjacent to the two lots on Miami Avenue, our family never considered them to be one piece of property. The cottage lots came down through my father's side of the family,and the Miami Avenue lots were most definitely my mother's inheritance lots. It did not occur to my parents that the lots would be considered one property. Both the Miami Avenue lots and the cottage lots are similar in size to each other and to the other lots of our neighbors. My parents always believed that since they paid separate tax bills and that the deeds came into the family through separate names that the lots were not joined. The fact that they shared a common boundary was incidental to them. The cottage lots had been my grandmother's while the Miami lots were my mother's. My husband and I have known for some years now that we would be relocating to the Peconic area eventually. At this point my parents do not want to undertake building for themselves. They would much rather continue to live in the white cottage that holds so many memories for them. My father no longer drives and as such they are not in a position to stay at the cottage for any length of time without one of my siblings driving out from Brooklyn to assist them with shopping and other chores. Knowing our plans to relocate,my mother suggested that we build on the Miami Avenue lots. Our entire family is tremendously excited at the prospects of our finally building on the lots purchased a half century ago. I am a diabetes nurse specialist. I will be completing my nurse practitioner studies this May. Our children will be graduating from college within the next year and a half. At that time, we will be in a position to permanently relocate to Peconic. We look forward to living in Peconic; being close to my parents and having enough space-lot other family members to visit with them. Every summer when I was growing up,my aunt and uncle,Theresa and Tom Reilly, would come out to visit us in Peconic with their four kids from Nassau County. Now they live in Cutchogue and their son just bought a house in Southold. My mother's siblings and their children are all regular visitors. And as my mother says it all started with a dream of building a house on Miami Avenue. It may be fifty years later and another generation but we are hoping to finally be able to fulfill that dream. While I still hope to be able to attend the hearing in person to vehemently protest their plan to unmerge the lots directly across the street from my home and the protected wetlands of Goldsmith's Inlet, I may not be able to re-arrange my work schedule to do so. I was unexpectedly offered the opportunity for a coveted slot at Instructor Development School at the Suffolk County Police Academy in Brentwood. Rarely is a civilian selected to become certified by the Bureau of Municipal Police to teach at the Police Academy. The current plan is to cut one day off the course since we are a small group and should finish up by Wednesday. However, I would appreciate your including my written comments in your deliberations. This topic stirs up strong emotions, I'm sure, on both sides of the issue. While at work, my arguments would generally be based on the simple facts, there is a place for the emotional factor, It is difficult to publicly oppose the request of a neighbor and potential neighbor. However, I cannot and will not stand idly by and not speak against what I see as the overdevelopment occurring in Southold Town and the potential devastation to the so-called "protected wetlands" and the very rural character of Southold itself. I realize that you must weigh competing interests. And I respect that those of you who have made your full-time home in Southold, often for generations, have great respect for the land and the way of life I share only part-time. I am the proud owner of the tiny little cottage with the big garage and the big tree as people know it (legally, it's 2460 Mill Lane or Mill Road or Inlet Road, depending on who you talk to) since 1991. It is directly across from the property in question. It is literally the home of my dreams. When a colleague from Soundview Avenue told me that a tiny cottage was being renovated and for sale on Goldsmith's Inlet, it sounded perfect. Sadly, it was way out of my price range. For about two years I looked and looked. But nothing compared to the tiny cottage I still dreamed about at night. Not only was the house really adorable, but the block itself had such charm. Lots of tiny homes built with love over many years. A few newer homes tastefully built such as the A-frame across the road I also considered(but still too expensive)where builders had taken great care to preserve the natural landscape. When the stock market crashed and my friend told me it was still on the market, I jumped at the chance to make my dream come true at a S i i 1 cost I could now afford. My broker made very clear to me that I had various restrictions because my home was in the wetlands. She made clear that Miami was a private road and where my property ended and their property began. I assured the Miami homeowners I respected those boundaries and supported their wishes to keep the natural landscape. I honored the Southold Trustees restrictions and obtained a permit when I originally trimmed my property on the inlet. For years now, I've let nature have its way and now enjoy the privacy that my somewhat overgrown property provides. When hurricanes or speeding drivers knocked down my trees, I hired local folks to save them. My neighbors congratulated me on my successes and commiserated when we lost one gorgeous specimen that had graced Miami next to my home. Some of us cried. I know I cried when I saw what the builder had done to the lot across the street from me and how Miami was devastated also. I had immediately alerted the Police and the town building department when this all began. A surveyor had asked if I knew where my cesspool and well were. I told him I did not. Shortly thereafter,the clearing was begun and a large hole appeared across the street. As the mother of a young child, I was worried about the risk to children and notified a Police Officer in the area. The hole was not secured in any way. There was no building permit posted. I then called the building department and was told no permit had been issued yet but someone could do a test well without one. To make a long story less long, eventually a fence that promptly fell down was erected around a huge muddy mess. I was gravely concerned about safety and the possibility of West Nile. More and more land was cleared, yet no permit was obtained. My neighbors became increasing concerned. Now we have been notified that a building permit has been denied and the O'Malley's are appealing that decision.How were they allowed to get this far? I have been told that Mr. McGuire had previously informed a neighbor that they had wanted to do this years ago but were stopped when neighbors objected. If this is accurate, was all this done deliberately to get a variance after the fact?Does the permit application infer that they thought the lots were already separate?Were all questions completed truthfully and fully? Was the section about proximity to wetlands correct?Did they answer every question? If not, why not?Where did they get the information about my well and cesspool?Please tell me, because I do not see them on my survey. How is it that the Peconic Land Trust is working so hard to preserve land on both sides of me and all down the block but a few feet away, it's fine to just mow down an entire ecosystem, including private property on Miami that others own?Isn't the town concerned about that? If your laws don't currently cover this, shouldn't they? I was raised in what used to be called"Brentwood in the Pines" in a tiny little house that was hand built. My paternal grandparents had lived there before me and my maternal grandparents lived down the road as did my aunts and uncles in their own tiny little houses. We ate eggs from our own chickens, preserved berries from our bushes and traded apples, tomatoes and corn with neighbors and relatives. When our trees were knocked down by hurricanes, the fire trucks came and pulled them back up. Some lived for forty more years. Sadly, hardly anyone even remembers calling Brentwood "Brentwood in the Pines" any more. Almost 30 years ago, I chose Manorville for my first home. After looking long and hard, I selected Manor Woods because the builder believed in,saving as many trees as possible. Much of our farmland is still being preserved, but certainly Manorville is far different today. I realize that this letter is long, but I see Southold as at a crossroads. Southold may be the final frontier on Long Island. You have a chance to keep the rural character of this town. We already have one"McMansion" further down the road. I believe that each time you allow one more"unmerging" and then"re-merging" you bring us one step closer to what Brentwood became. If people want vastly larger homes with lots of lawn and no trees,perhaps a part of Southold away from protected wetlands may have the zoning already. Please do not allow this variance to be approved. It seems to be just another step in the process and will likely to lead to more requests as is implied in the application. Soon the whole block will be in danger as more homes pass on to the next generation. Ironically, the little remaining buffer of land that was not bulldozed on Mill is slated to be the"proposed driveway" and not the already cleared entrance on Miami. Is that because of the flooding and dirt repeatedly flowing into the street because there is no vegetation left to contain the water? I am desperately worried that the water is going to flood my home already?I don't want to sue my neighbors. I want the situation rectified. Thank you for the opportunity to be heard.
