Orr) Property Location: 1300 Leeton Drive, Southold; CTM 58-2-1. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 16,227 sq. ft. is a vacant lot with 100 ft. frontage along the north side of Leeton Drive, 100.09 feet along the average high water mark of the Long Island Sound, 160.12 feet along the westerly lot line, and 164.42 feet along the easterly lot line. BASIS OF APPLICATION: Building Department's March 3, 2004, Notice of Disapproval, citing Code Section 100-244 in its denial of a building permit application concerning a proposed new dwelling at less than 35 feet from the front lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at which time written and oral evidence were presented, Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant's original application requested a new dwelling with an attached 4 ft. by 24 ft. front porch that would have created a 23 ft. front yard setback, at its closest point, as shown on the March 10, 2003 survey prepared by John C. Ehlers, L.S. ADDITIONAL INFORMATION:AMENDED RELIEF: During the May 20, 2004 public hearing, the applicant voluntarily offered to eliminate the front porch and move the dwelling back 6 feet, which would increase the requested setback from 23 feet to 33 feet, a two-foot deviation from the 35 ft. code requirement. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alternative variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wishes to construct a new dwelling and this minor, two foot variance will not appear out-of-place with neighboring properties. 4 Pag�•2—June 3,2004 ZBA No.5519—Paul Orlick - CTM 1000-58-2-1 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the applicant is restricted by environmental regulations from encroaching any closer to the sound-front rear yard area. Without a variance, the applicant will not be able to construct a new house. 3. The alternate variance granted herein is not substantial and represents a two-foot reduction in the code requirement. 4. The alleged difficulty was not self-created and is due to the environmental constraints of the property. 5. No evidence has been submitted to suggest that the relief granted will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by Member Goehringer, and duly carried, to DENY the relief requested for a 23 ft. front yard setback, and to GRANT an alternative variance for a 33 ft. minimum setback, at its closest point to the front property line, as confirmed at the May 20, 2004 public hearing by the applicant. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Currently there are residential dwellings immediately situated to the east and west of the subject parcel that are in excess of 3,000 square feet b. The character of the neighborhood is evolving as a community of moderate to large homes c. The requested variance is nominal and in form with several of the existing and proposed homes in the immediate neighborhood d. The subject parcel is larger than surrounding parcels resulting in similar gross floor to parcel size ratio e. Tax Map #58-2-1. 1300 Leeton Drive Southold ' Dear Chairwoman Oliva: As requested by the Town of Southold Board of Appeals, the Orlick property located at 1300 Leeton Drive has been evaluated by reviewing the,provided plans and conducting a site visit. The following are our observations and recommendations in regard to reviewing this property. The Suffolk County Soil Survey indicates that the property is located on beach and dune material, which was verified during our site visit. The northern portion of the property is beach on Long Island Sound with the southern boundary touching Leeton Road. Houses on both the eastern and western property boundaries,border the property. A stable dune exists above the high tide line on the northern portion of the property and is well vegetated with Beach grass and Seaside Goldenrod. On the north side of the dune is a stable beach,which does not appear to be eroding. A preexisting wooden walkway and small A-frame shed are in good condition and located on the top of the dune. The soil surface along the Leeton Road is stable with no active erosion. The general vegetation is dominated by Oriental Bittersweet, Virginia Creeper, Honeysuckle, and- Beach Plum,while Poison Ivy dominates the core of the property. Our greatest concern at the site is the pro Ction of the dune. As you are aware, dunes serve as protective buffers against coastal erosion and:flooding from storm surges as well as provide wildlife habitat. It is our recommendation that no additional structures should be built on the top of the dune, nor should the dune be removed; as has been done on the Western property. Thus,the proposed house should be sited as far as possible south from of the dune. This action will thereby preserve as much of the dune as possible while allowing the house obtain the full protective benefit from storms and flooding that the dune offers. 423 GRIFFING AVENUE - . SUITE 110 RIVERHEAD, NY 11901 ' S , The dune is currently in very stable condition, however precautions should be taken,to protect it, as it is a very fragile environment. The beach grass and other vegetation is very susceptible to foot traffic, thus access to,and from the beach should be encouraged on the wooden path, which already exists on site. It will be equally important to protect the dune from construction activities. The installation of temporary orange snow fencing around the perimeter of the dune is a very effective means to prevent access and identify,protected areas. "Cape" American Beach grass is the appropriate plant for repairing any damage to the dune whether caused by human or storm activity. The"Cape" American Beach , grass should be planted on the dunes, in 18 inch spaced rows in late fall or early winter. Due to the close proximity of the proposed house to the dune, all roof runoff should.be diverted away from the dune. This can be accomplished by fitting the house with gutters and down spouts which discharge into buried,drainage rings. Suchaninstallation will compensate for the increase in impermeable area caused by the house and thereby prevent erosion on the dune and Leeton Road. Lastly, as nutrient loading is a concern within Long Island Sound, we recommend that any landscaping activities use native plantings. Beach Plum, Bayberry, Beach Pea, Seaside Goldenrod, Cape American Beach grass, and Red Cedar are examples of native Long Island plants appropriate for this site. As these plants are able to tolerate the harsh climate of Long Island, limited additions of nutrients, pesticides, and water will be needed in order for these plants to thrive. Thus, Long Island Sound will not be impacted by the choice of landscaping selected for this property.
