The Board of Town Trustees took the following action during a Regular Meeting,held on May
21, 2003 regarding the above matter
WHEREAS, Catherine Mesiano, Inc.. on behalf of Arsak Terjanian applied to the Southold
Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated May 1, 2003
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
May 21, 2003 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS,the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS,the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS,the Board has determined that the project as proposed will not affect the health,

safety and general welfare of the people of the town.
NOW THEREFORE BE IT,
RESOLVED,that the Board of Trustees approved the application of ARSAK TERJANIAN
request a Wetland Permit "as-built"rock retaining wall. stairs and decking within 100' of tidal
wetland based upon change of plans—showing the removal of rocks around stairway -removal
of rings—show the revetment of the stones along the bluff and the slope shown on a survey—
removal within ninety days from receipt of permit.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency,which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$5.00 per inspection. (See attached schedule).

At the meeting of the Southold Town Conservation Advisory Council held Tuesday, May
13, 2003, the following recommendation was made:
ARSAK TERJANIAN for the "as-built" retaining wall, stairs, and decking within 100' of
the tidal wetlands.

The CAC did not make an inspection, therefore no recommendation was made.

Dear Mr. Krupski:
I am the agent for the above reference applicant. On behalf of Mr. Terjanian, enclosed
is an application for a Wetlands Permit and Coastal Erosion Permit for a an "as-built'
rock retaining wall and stairs, pursuant to a Notice of Violation dated 5/01/2002 and in
response to your letter dated November 12, 2002. Also enclosed are three prints of a
survey dated March 19, 2003 prepared by Fox Land Surveying and Mr. Terjanian's
checks totaling $300, the balance of the application fee due. No_"plan" is submitted as
no activity is proposed. The--application is for existing conditions only. Photographs,
enclosed, indicate the area of rock referred to in the violation.
Mr. Terjanian was issued a Notice of Violation by the Bay Constable on May 1, 2002 for
placing "a rock retaining wall within a Coastal Zone Erosion Area" and placing "a rock
retaining wall within 100' of a tidal wetland". The "rock retaining wall" as noted in the
Violation Information consists of a series of small rocks picked up from the beach and
placed by hand on the face of the slope in a decorative manner. The Notice of Violation
also notes that "stairs and decking have been placed within 100' of a tidal wetland
without a permit". The "decking" referred to in the violation consisted of material placed
on the beach at the foot of the westerly steps and has been removed. It should be
noted that the matter was resolved in the Southold Justice Court.

Dear Mr. Krupski:
am the agent for the above reference applicant. On behalf of Mr. Terjanian, enclosed
is an application package for a Wetlands Permit for a pre-existing "retaining wall".
Mr. Terjanian was issued a Notice of Violation by the Bay Constable on May 1, 2002 for
placing "a rock retaining wall within a Coastal Zone Erosion Area" and placing "a rock
retaining wall within 100' of a tidal wetland". The "rock retaining wall" as noted in the
Violation Information consists of a series of small rocks picked up from the beach and
placed by hand on the face of the slope in a decorative manner. The Notice of Violation
also notes that "stairs and decking have been placed within 100' of a tidal wetland
without a permit". I am enclosing a copy of a 1985 survey which clearly shows "steps"
and "boardwalk". This application is being submitted to cure the violation. However,
am unsure as to whether of not the "retaining wall" is actually a "structure" or"activity"
for which a permit is required. If, in your opinion, a permit is in fact necessary, then we
wish to proceed with the application process.
Please be advised that I would like to meet the Trustees at the site during their field
inspection.
