Price, Jr., Esq. 100 Bay Road, Greenport, NY Dear Mr. Anderson: The following action as taken by the Board of Town Trustees during a Regular Meeting, held on May 22, 2002, regarding the above matter. WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of William H. Price, Jr., Esq. applied to the Southold Town Trustees for a permit under the provisions ofthe Wetland Ordinance of the Town of Southold, application dated November 19, 2001 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 22, 2002 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. . 2 . WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT. RESOLVED, that the Board of Trustees approved the application of William H. Price, Jr., Esq. for a Wetland Permit to construct a 1725 s.f, single family dwelling (footprint) with a 550 s,f, attached deck (footprint) an 865 s.f. gravel driveway, septic system and waterline, and place 125 cy of fill to elevate the septic system with the condition that the Town be notified regarding the culvert that is draining onto the property, row of hay bales 50' from the wetlands, no turf on the seaward side of the house. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Fee must be paid, if applicable and permit issued within six months of the date of this notification. If inspections are required, at a fee of$5.00 per inspection (See attached schedule). SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL At the meeting of the Southold Town ConserVation Advisory Council held Thursday, December 13, 2001, the following recommendation was made: Moved by Scott Hilary, seconded by Jason Petrucci, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of WILLIAM H. PRICE JR., ESQ. to construct a 1725 sf. single family dwelling (footprint) with a 550 sf. attached deck (footprint), an 865 sf. gravel driveway, septic system and waterline; and place 125 cy. of fill to elevate the septic system house. Located: 100 Bay Rd., Greenport. SCTM#43-5-10 The CAC recommends Disapproval of the application because the proposed structure was not staked. The landward edge of the wetlands should be identified and flagged. There is also a concern with the flood-tide mark in relation to the proposed structure. The CAC has a concern with the existing pipe and the re-direction of the road run-off. The CAC recommends that the structure is moved 75' from the wetlands. I have also highlighted an area where the Town apparently has installed a drain to drain road runoff onto my property. I have had no objections until now to the location of the drain. Now that I am building a house, an alternate method of dealing with the road runoff will have to be arrived at. The Town Trustees have raised the runoff as an issue that must be dealt with at our earliest convenience. I am willing to work with the Town in order to come up with a viable solution provided that it does not alter the plan for the location of my dwelling or septic system. Price Jr. SCTM# 1000-43-5-10 Gentlemen: I represent Paul Jeselsohn and Francis Dubois, who own property directly across Bay Road, Greenport, rrom the above-referenced lot owned by William H. Price Jr., which is the subject of tonight's public hearing. The hearing is being held in connection with Mr. Price's application for a wetlands permit for a single family house and associated structures. Please include this letter in the record of the hearing. Last week, I visited the neighborhood to get an idea of the existing architectural styles and natural features. I was struck, first of all, by the modest size of most of the houses on Bay Road, especially those on the Gardiners Bay waternont ( see enclosed photographs numbered I through 5, taken 2/15/99). Although Mr. Price's application states that he is proposing a house with a footprint of 1,725 square feet, I understand rrom his representative, Bruce Anderson, that the house will contain approximately 3,500 square feet. That size house, together with 550 square feet of decking, is much larger than most ofthe houses on either side of Bay Road. I understand rrom my clients that the large (for the neighborhood) house adjacent to the Price lot ( see photograph number 6 ) was done as a renovation to an existing structure. I submit that the different rules regarding development oflots with existing structures, mainly dealing with the issue of vested rights, make this lot not a fair comparison to the Price lot, which is currently vacant. The same must be said of the lot to the other side ofthe Price lot, whose owners,l understand, have recently received a permit to expand. As to the natural features of the Gardiners Bay-rront neighborhood and the Price lot in - . . . . particular, I noticed last week that the lot, which is waterftont, is full of phragmites and other marsh-like vegetation. The vegetation extends as far as the fence at the road ( see photographs numbered 7,8, and 9, taken 2/15/99). This indicates to me that the lot often contains standing water. Indeed, my clients have taken photographs following a "northeaster" storm that clearly show areas of water and seaweed deposits on the Price lot (see photographs numbered 10, II and 12). Although the Price survey shows a wetlands edge 69 feet away ftom the nearest structure, it appears ftom a visit to the site and the photographs that my clients and I have taken that the lot is far more constrained environmentally than the survey would lead one to believe, and that the development that is planned is fur too extensive for the sensitive nature of the property. On behalf of my clients, I respectfully ask you to consider the existing style and size of development in the neighborhood, and the envirnonmentally constrained nature of the Price lot, and scale back the Price proposal accordingly.
