ADDITIONAL GENERAL CONDITIONS FOR ARflCLfS 1S (Title S). 24, 2S, 34, 36 .nd 6 NYCRR Port 608 ( 10 That if future operations by the State of New York require an al- teration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation It shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause 105s or destruction of the natural resources of the State. the owner may be ordered by the Department to remove or alter the structural work, obstructions. or hazards caused thereby without expense to the State, and if. upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be com· pleted, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 11 That the State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may·be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation. or for other purposes, and no claim or right to compensation shall accrue from any such damage. 12 Granting of this permit does not relieve the applicant of the responsi- bility of obtaining any other permission. consent or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services or local government which may be required. 13 All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any ) other environmentally deleterious materials associated with the project. 14. . Any material dredged in the prosecution of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 15. There shall be no unreasonable interference with navigation by the work herein authorized. 16. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 17 If granted under Article 36, this permit does not signify in any way that the project will be free from flooding. . 18 If granted under 6 NYCRR Part 608, the NYS Department of Environ- mental Conservation hereby certifies that the subject project will not contravene effluent limitations or other limitations or standards under Sections 301, 302, 303, 306 and 307 of the Clean Water Act of 1977 (Pl 95-217) provided that all of the conditions listed herem are met. 19. All activities authorized by this permit must be in strict conformance with the. approved plans submitted by the ðpplicant or his agent as part of the permit application. A Þe~ shall be constructed around spoil site before placement of dredged material. 2. Dredging will be limited to 10 foot width from pedestrian bridge area to area 250 feet southwest of this bridge. 3. Dredge must be by hydraulic means only. 4. No bulkhead construction is permitted as part of this permit. 5. To protect the values of the tidal wetland, a permanent vegetated buffer zone shall be established. There shall be no disturbance to the natural vegecation or topograph. within an area extending 25 linear feet landward of the tidal wetland boundary, 6. All dredged material shall be disposed on an upland site and be suitably retained so as to not reenter any water body or tidal wetland area. 7. All side slopes of the dredged channel will have a maximum of 1:3 slope. 8. No dredging will occur within 20 linear feet of the seaward edge of the intertidal marsh. 9. The use of a dragline for dredging adjacent to the vegetated tidal wetland is strictly prohibited. 10. There shall be no disturbance to vegetated tidal wetlands as a result of the permitted activity. 11. Dredging is prohibited from May 31st through October 31st each year, 12. Dredging shall be undertaken no more than once in any calendar year unless specifically authorized by the Department (one time only). If any of the permit conditions are unclear,the permittee shall con- tact the Division of Regulatory Affairs at the address and telephone notëd belo>l. B. A copy of this permit with supplementary conditions and approved plans shall be available at the projëct site whenever authorized work is in progress. C. The permit sign enclosed with the permit or a copy of letter of approval shall be protected from the weather and posted in a con- spicuous location at the work site until completion of authorized work. D. At l",ast 46 hours prior to commencement of the project, the permittee shall complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form shall also be com- pleted arId returned. E. For projects involving activities to be accomplished over a period of ¡(¡ore than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours prior to the commencement of resumption of work each year. F. If project design modifications take place after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regiona] Permit Administrator prior to undertaking any such l!lodi- fications. Box 342 East Marion, New York 11939 Dear Mr. Matzen: In accordance with the provisions of Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403), your organization was issued Department of the Army Permit No. 15595, by the District Engineer on January 31 1990. This permit authorized you to construct 115 feet of subgrade bulkhead with a 4 foot wide catwalk elevated above the bulkhead and wetlands, and to dredge an area approximately 6 feet waterward of the catwalk to 3 feet below mean low water with 40 cubic yards of material to be placed at an upland location, where it would be suitably retained from reentering the waterway. The activity is located in Spring Pond, Gardiners Bay, at East Marion, Suffolk County, New York. The permit described above is hereby modified to allow for the maintenance dredging of an area 1,030 feet long and 20 feet wide to 4 feet below mean low water, removing approximately 600 cubic yards of material to be placed at an upland site east of the canal. A berm shall be constructed around the site to prevent the dredged material from reentering the waterway. Dredging will occur three times over a ten year period with all dredged material placed at the aforementioned uplaHd site. This permit modification supercedes Permit #15595A which au·t1lOrized the dredging of a 250 foot by 10 foot channel. The other original conditions to which the authorized work was made subject including the special conditions of the attached New York State Department of Environmental Conservation Permit shall remain in effect. This concurrence is without prejudice to, and does not obviate the need to obtain all other applicable licenses, permits, and approvals required under existing State statutes. Spoil site and crane location must be at least 35 feet from the subgrade hulkhead. 3 All necessary precautions shall be taken to prevent contamination of the tidal wetlands and or waters of New York by silt, sediment, fuels, solvent, lubricants, epoxy coatings, concrete leachate and any other pollutant associated with project work. 4. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an apptov~d upland acea tor uisposal. No debris is permitted in tidal wetlands. 5. The storage of cOnstruction ëquiPment and materi~ls shall be confined to within the project work site on'work barge or ·upland areas greater than 25 feet landward of tidal wetland boundary, 6. The permit sign enclosed with the permit or a copy of letter of approval shall be protected from the weather and posted in a con- spicuous location at thè work site until completion of authorized work. At least 48 hours prior to commencement of the project, the permittee shall complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form shall also be com- pleted and· returned. E. For projects involving activities to be accomplished over a period of more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours prior to the commencement of resumption of work each year. F. If project design modifications take place after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modi- fications. The permittee is advised that substantial modification may require submission of a new application for permit. G. All necessary precautions shall be taken to preclude contamination of any wetlands or waterway by suspended solids, sediment, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project work. H. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. I. (Maximum dimensions of deck will be 43'6" x 16'6". The Council recommends disapproval because it feels the area would be better served with a bulkhead. A stone revetment would cause more damage. RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 636 of Andrew and Bernice Lettieri to build an elevated catwalk over fringe of marsh and install an offshore mooring pipe. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis.
