The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the 'event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon recejpt by the Trustees' of written notice from such other governmental or municipal authorities of its refusal or disapproval. ~ '11.'/"'':;;- r The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms. aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. Smith: Please be advised that the work on maintenance dredging of the inlet to spring Pond from Orient Harbor is now com- plete and all fees have been paid. In compliance with our Wetlands Permit, granted vy the Town of Southold on Oct 15. 1984,we are now seeking an ex- tension of 10 years. It is now very apparent thãt the tidal action between Orient Bay and Spring Pond has caused the inlet to silt badly and since we are so vulnerable to severe storms, it is antxcipated the inlet may be subjected to dredging many times during the next few years. Extensions to Gardin- ers Bay Estates have been granted before by the D.E.C. in 1978 and the Army Corps in 1976 (see enclosed photostats). Hopefully the Board will accommodate this request. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned. Because there has been a response from the Southold Town Conservation Advisory Council indicating that this project would not have a significant effect to the environment. Because there has been no response in the alloted time from the New York State Department of Environmental Conservation and the Southold Town Building Department, it is assumed that there are no objections nor comments from those agencies. Trustee Kujawski: There were a few boats around when we were there. I guess about a month ago- I'm trying to figure out how come you are looking for that type of depth, in this area. A survey showing the origional depth taken in 1925 was shown. This is spring pond before it was done, this is a survey (1925) depths, showing map, and this is a survey showing depths in 1979. You see that the origional dredging, took place in 1926. Trustee Smith: You lost me here. Is this where it goes back into ... The bay constable can help you out. Frank Kujawski: This doesn't really correspond. Inside. Frank Kujawski: Not for the project area. Correct me if I'm wrong. You do want to do more than the mouth. No. We have permits from the DEC and the Army Core of Engineers to do all the way to the bridge, we are not looking for that. That was not reflected in the application. If that's the case, I do not think you have any problems at all. Trustee Smith: I was under the impression that you were going to do all the way under the bridge, and right on through. No, not at all. The DEC application reads differently. They give permission to dredge to the bridge. We have a copy of their permits. We were under the impression that you not only want to do the mouth, but make the right hand turn move all the way up here. No sir. Which would be a problem. Through the inlet here, but also makes the right hand turn, . . here is the footbridge. This whole area moving up to the footbridge and this whole area, we have a 20 ft. width average and removal of an extimate 600 cu. yds. of sand. If you look at the environmental assessment it says 500 yds. The point is you are not going to make a right hand turn. No sir. I think we can retype this. The problem was from the storm last March . All we have to go by is the hand drawn sketch. The hand drawn sketch shows dredging to a 20 ft. width right up to the foot bridge. I'm willing to retype this from a type 1. This is sand removal. John Bredemeyer. That was our initial determination. after a long environmental assessment form we can retype ir. the project, as non-significant. Thats the reason for the long environmental assessment form. There will be a public hearing on this matter on Jan. 30, 1985. ThJt if fulure operations by the State of New York require an alteralion in the position of Ihe structure or work herem authorized. or if, in the opinion of the Department of Environmenlal Conservation it shall cause unreasonable obstructIon 10 the free navigalion of said waters or flood flows or endanger the heallh. sJfety or welfare of the people of the Stale, or loss or destruction of Ihe natural resources of the Stale, the owner may be ordered by Ihe Deparl- ment to remove or aUer the slruclural work, obstructions, or hazards caused thereby without expense to the State; and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners shall, without expense to the State, and to such extenl and in such time a~ manner as the Departmenl of Environmenlal Conservation may require, remove all or any perllon of the uncompleled structure or lill and reslore to its former condition the navigable and flood capacity of the walercourse. No claim shall be made against the Slate of New York on account of any such removal or alleration. 95.20-1 (9/75) 8. That the State of New York shall in no case be liable for any damage or injury 10 the slructure or work herein authorized which may be caused by or resull from future operations undertaken by the State tor the conservalion or improvement of navigation, or for other purposes, and no claim or right to compensalion shall accrue from any such damage. 9. That if the display of lights and signals on any work hereby authorized is not otherwise provided for by law, such lights and signals as may be pre- scribed by Ihe United States Coast Guard shall be installed and maintained by and at the expense of the owner. 10. All work carried out under Ihis permit shall be performed in accor· dance with established engineering practice and in a workmanlike manner. 11. If granted under Articles 24 or 25, the Department reserves the right 10 reconsider this approval at any time and after due notice and hearing to continue, rescind or modify Ihis permil in such a manner as may be found to be just and equitable. If upon the expiralion or revocation of this permit, the modificatIon of the wetland hereby authorized has not been completed, the applicant shall, without expense to the State. and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of Ney,. York on accounl of any such removal or alteration. 11. This permit shall not be construed as conveying to the applicant any right to trespass upon the lands or interfere with the riparian rights of others to perform the permitted work or as authorizing the impairment of any rights, title or interest in real or personal property held or vested in a person not a party 10 the permit. 13. The permittee is responsible for oblaining any other permits, ap- provals, lands, easements and rights..of.way which may be required for this project. 14. If granted under Article 36, this permit is granted solely on the basis of the requirements of Article 36 of the Environmental Conservation Law and Part 500 of 6 NYCRR (Construction in Flood Plain Areas having Special Flooc Hazards - Building Permits) and in no way signifies that the project will Ix free from flooding. 15. By acceptance of this permit the permittee agrees that the permit is contingent upon strict compliance with the special conditions on thf reverse side. (SEE REVERSE SIDE) SPECIAL C"NDITIONS 16, Applicant shall be liable for any damage to adjacent waterway resulting from any phase of the permitted construction. 17. Dredging shall be limited to four feet below M.L.W. and spoil shall be placed on adjacent upland and prevented from re-entering waterway. SPECIAL NOTE: Based upon a review of this project and a request for water quality certification pursuant to Section 401 of the Federal Water Pollution Control Act Amendments of 1972, Public Law 92-500 (the "Act") public notice for which has been duly given, the Department of Environmental Conservation hereby certifies that the applicant will comply with applicable provisions of Sections 301, 302, 306 and 307 of the Act, provided tha t: 1.
